(a) Any person issued a summons to appear for violation under Article 1729 of the Municipal Code of the City of Dunbar pursuant to Section 1729.03 shall be punishable by a fine as follows: within any 12-month period, $100.00 for the first violation, $200.00 for the second violation, $300.00 for the third violation, and $500.00 for each violation thereafter, subject to subsection (b) below.
(b) Any person issued a summons to appear pursuant to Section 1729.03 for violations under Section 1729.01 shall have the summons dismissed provided that the defendant produces evidence that the Code violation that caused the summons to appear to be issued has been corrected within ten days (including weekends and holidays) of the date of receipt or posting of the summons to appear and verified by the enforcement official.
