(A) Records, minutes, budgetary requirements. The Town Council and the Planning Board shall provide for the appropriate keeping of records, minutes and other proceedings held with respect to the Planning Board’s responsibility under the terms of this chapter, and the Town Council may provide for budgetary requirements as may be necessary in the administration of this chapter.
(B) Amendments. The Town Council may amend this chapter from time to time through a legislative hearing and decision.
(C) Conflicts with the Zoning Chapter. Should the requirements of this chapter conflict with those of the Town of Duck Zoning Chapter, the more stringent requirements shall prevail.
(D) Violations.
(1) Any person who, being the owner, or agent of the owner, of any land located within the jurisdiction of this chapter 4 transfers or sells the land by reference to, exhibition of, or any other use of a plat showing a subdivision of the land, before the plat has been properly approved in accordance with this chapter and recorded in the Office of the Register of Deeds, shall be subject to the civil penalty set forth in § 10.99 per violation. The person cited for the violation must pay the civil penalty within five days of being cited for the violation. In the event that the person cited for the violation does not pay the civil penalty within the prescribed time, the town may bring a civil action to recover the penalty and the associated court costs.
(2) The description of metes and bounds in the instrument of transfer or other document used in the process of selling or transferring shall not exempt the transaction from the penalties provided therefore.
(3) The town may also seek injunctive relief for the illegal subdivision, transfer and conveyance of sale of land.
