(A) Any person violating any provisions of this chapter, for which no specific penalty is prescribed, shall be subject to § 10.99.
(B) Any person in violation of § 130.01 shall be subject to enforcement by law enforcement officials serving in the county, and the Board of Commissioners, which shall be authorized to impose, as a penalty, a fine not to exceed $2,500, provided that nothing herein shall prevent prosecution of said violation in any court of record.
(C) A person who smokes or uses tobacco, or prohibited products, in an area where smoking tobacco, or related products, are prohibited by the provisions of § 130.02 shall be guilty of an infraction, punishable by a fine not exceeding $250 per infraction. Each day on which a violation of § 130.02 occurs shall be considered a separate and distinct violation. The principal agency charged with responsibility for the enforcement of § 130.02 shall be in the County Sheriff’s Department.
