§ 130.02 SMOKING, NICOTINE INSIDE COUNTY BUILDINGS.
   (A)   Smoking, or use of products derived from tobacco, tobacco-free alternatives, or recreational drugs or products, shall be prohibited in all buildings and structures owned, leased, operated, or otherwise occupied by the county, including all areas within said buildings and structures, or any addition thereto, and in any area outside such building within eight feet from each entrance thereto, or within eight feet from any air intake to said building.
   (B)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      PRODUCTS DERIVED FROM TOBACCO. Includes, without being limited to, cigarettes (including clove, bidis, and kreteks), electronic cigarettes, aerosol or vapor nicotine delivery devices, cigars and cigarillos, pipe tobacco, hookah-smoked products, and oral tobacco (spit and spitless, smokeless, chew, and snuff).
      RECREATIONAL DRUG. A drug, often illegal, such as marijuana, cocaine, or meth, occasionally used without medical justification for its psychoactive effects.
      SMOKE or SMOKING. To ignite, or cause to be ignited, tobacco or a tobacco product, or derivative, which includes, but is not limited to, e-cigarettes, or other devices utilized for vaping, such that the product, or derivative, emits a gas, or cloud, which may be, or is, intended to be inhaled by any person. It shall include exhaling from, burning, or carrying any lighted, or heated, tobacco, or plant product, intended for inhalation, whether natural or synthetic. To SMOKE also includes the use with any such tobacco, or plant product, of a pipe or hookah; of any electronic smoking device which creates, in any manner, an aerosol or vapor, in any form; or of any other oral smoking device.
      TOBACCO. Any of several plants belonging to the genus Nicotiana, of the nightshade family, whose leaves are prepared for smoking or chewing, or as snuff; the prepared leaves, as used in cigarettes, cigars, and pipes, or any product, or products, made from such leaves; and any of the various similar plants, or other genera.
   (C)   This section is not intended to prohibit medically prescribed products or replacement products, including, but not limited to, gum, lozenges, patches, or like products used to assist the user as a health aid.
   (D)   Application of this section as to use of tobacco products in the County Security Center may be revised by rules established by the County Sheriff.
