Notwithstanding any other provision of this chapter, the proprietor of a business or outdoor area which does not otherwise qualify as a public place or place of employment or any public place or place of employment otherwise exempt from the provisions of §§ 94.11 and 94.12 may declare such location as a nonsmoking place. Smoking shall be prohibited in any place in which a sign conforming to the requirements of § 94.16 is posted.
