As used in this chapter:
BICYCLE: A wheeled vehicle: propelled by human power by feet or hands acting upon pedals or cranks; with a seat or saddle designed for the use of the operator; designed to be operated on the ground; and whose wheels are not less than fourteen inches (14") in diameter. "Bicycle" includes an electric assisted bicycle.
DEPARTMENT: The Draper City Parks and Recreation Department.
DIRECTOR: The Draper City Parks and Recreation Department Director.
ELECTRIC ASSISTED BICYCLE: A bicycle with an electric motor that:
A. Has a power output of not more than seven hundred fifty watts (750 W);
B. Has fully operable pedals on permanently fixed cranks;
C. Is fully operable as a bicycle without the use of the electric motor; and
D. Is one of the following:
1. Class I is an electric assisted bicycle equipped with a motor or electronics that:
a. Provides assistance only when the rider is pedaling; and
b. Ceases to provide assistance when the bicycle reaches the speed of twenty (20) miles per hour;
2. Class II is an electric assisted bicycle equipped with a motor or electronics that:
a. May be used exclusively to propel the bicycle; and
b. Is not capable of providing assistance when the bicycle reaches the speed of twenty (20) miles per hour; or
3. Class III is an electric assisted bicycle equipped with a motor or electronics that:
a. Provides assistance only when the rider is pedaling;
b. Ceases to provide assistance when the bicycle reaches the speed of twenty eight (28) miles per hour; and
c. Is equipped with a speedometer.
MANAGER: The Manager of the Draper City Parks Division, Recreation Division and/or the Manager of the Trails and Open Space Division.
MUDDY TRAIL: The condition of a trail in which the surface is saturated with enough water to cause damage such as erosion, rutting and/or soil displacement or other damage when traveled upon.
NATURAL RESOURCE: Any open space, conservation area, land, water, vegetation, mineral, fossil, wildlife, wildlife habitat or other space under the control of the City, regardless of whether such control is through ownership, dedication, lease, easement, covenant, memorandum of understanding, intergovernmental agreement, contract or other mechanism of control.
OFF HIGHWAY VEHICLE (OHV): Any snowmobile, all-terrain type I vehicle, all-terrain type II vehicle or motorcycle.
OPEN SPACE: Draper City-owned land that is in a predominantly open and undeveloped condition, which is primarily used for conservation, scenic, wildlife habitat, or non-motorized recreation uses.
PARK: A specific piece of ground, either within the City or that is under the ownership or control of the City that is operated and maintained by the City and set apart for the use of the general public, whether developed or undeveloped, including natural parks and open space, and that may be planted with trees, lawns and other shrubbery. A park may include within its boundary facilities for sport, entertainment, dancing, recreation, swimming, or similar functions. A park may be planned for any beneficial use by the citizenry. A park may have numerous facilities or may have no facilities.
RECREATION: A leisure activity or diversion which restores one's strength, spirit or vitality and which refreshes the mind or body.
RECREATION FACILITIES OR FACILITIES: Parks, trails, recreation areas, and recreation centers which are owned or operated by the City, or for which the City has enforcement or maintenance responsibilities.
STREET LICENSED VEHICLE: Any motorized vehicle such as an automobile, motorcycle or truck that is equipped and licensed for use on public roads.
TRAIL: A linear corridor of property which is part of the parks, trails and recreation master plan or which connects planned trails and is maintained by the City for the purposes of hiking, walking, jogging, running, equestrian, cycling, or other such use allowed by this chapter.
