10-3-020: APPLICATION FOR BUILDING PERMIT:
A.   Filing: Application for a building permit shall be made by filing with the Community Development Department a complete and accurate "Building Permit Application" and supporting documents required by the Construction Codes and other applicable laws.
B.   Residential Subdivisions: Building permit applications for residential construction on lots within a subdivision may be submitted and reviewed after the subdivision has been legally recorded with the County Recorder and the City has received the updated parcel information from the County Recorder and has inputted the parcel information into the City's GIS database. No building permit related to any residential construction will be issued until all public improvements related to the final subdivision have been completed, been accepted by the Engineering Division, the warranty period has begun, and written approval of all public agencies involved has been received.
C.   Construction On Existing Parcels: Building permit applications for residential and non-residential construction on existing parcels not within a subdivision shall be submitted and reviewed by the Community Development Department to determine the requirements for building permit issuance. The Community Development Department shall route applicable plans to the Engineering Division to determine frontage improvement and right- of-way dedication provisions. The Engineering Division shall determine the presence of adequate frontage improvements and right-of-way dedication in accordance with sections 9-27-100 and 9-27-110 of this Code. The Engineering Division shall inform the Community Development Department of the requirement and method by which frontage improvements shall be provided by the applicant. The Community Development Department shall inform the applicant of the Engineering Division's determination.
1.   Upon finding by the Engineering Division that certain frontage improvements are not required, the Community Development Department may issue the building permit provided all other conditions of the building permit issuance have been satisfied.
2.   Upon finding by the Engineering Division that certain frontage improvements are required, the building permit applicant shall prepare and submit improvement plan documents in accordance with sections 17-3-030 and 17-4-030 of this Code. The City Engineer will review the applicant's submittal documents in accordance with section 17-4-040 of this Code for compliance with title 17, chapters 3, 4 and 5 of this Code.
3.   Upon finding that the improvement plan documents for frontage improvement installation are complete, the building permit applicant shall post a form of security and enter into an improvement agreement in accordance with the provisions of section 17-4-070 of this Code. Upon completion of the improvement agreement, the City Engineer shall issue an encroachment permit in accordance with title 11, chapter 6 of this Code.
4.   Upon issuance of the encroachment permit, the Engineering Division shall notify the Community Development Department that the required documentation for the establishment of frontage improvements has been completed and the building permit may be issued provided all other conditions have been satisfied.
5.   No temporary or final occupancy permit shall be issued by the building official related to any residential construction unless all required frontage improvements related to the development of the parcel has been completed, accepted by the City Engineer, the warranty period has begun, and written approval has been received from all public agencies involved.
6.   No final occupancy permit shall be issued by the building official related to any non-residential construction unless all required frontage improvements related to the development of the parcel have been completed, accepted by the City Engineer, the warranty period has begun, and written approval has been received from all public agencies involved.
D.   Commercial Subdivisions: Building permit applications for non- residential construction on lots within a subdivision may be submitted and reviewed after the subdivision has been legally recorded with the County Recorder. Building permits for construction in commercial subdivisions may be issued prior to the completion of all public improvements subject to the following requirements being met:
1.   Continuous access to the lot through the subdivision is provided by a street with an all weather surface acceptable to the Fire Marshal;
2.   A trash receptacle with a secured lid or secured cover has been located on the site and not in the street, and shall be of a size and nature suitable for containing all construction-related debris until the debris is removed from the site;
3.   A sanitary toilet has been located on the site and not in the street for the use of construction workers; and
4.   Fire hydrants are fully operational with required fire flow capability in the area of the subdivision where permits are requested as required by the Fire Marshal.
E.   Occupancy Permit Required: There shall be no occupancy of any non-residential building in any zone until an occupancy permit has been issued. An occupancy permit shall not be issued until the following conditions are met and all work is acceptable to the City and appropriate agencies:
1.   All necessary utilities are installed including culinary water lines, sanitary sewer, flood control facilities, electric power, and natural gas lines;
2.   All required public improvements are installed;
3.   All Building Code requirements are satisfied; and
4.   All City conditions of site plan approval have been completed.
F.   Notification To Buyer, Builder Regarding Occupancy Permits: It shall be unlawful for any subdivider to sell any portion of an approved nonresidential subdivision until the prospective buyer or builder has been advised that occupancy permits shall not be issued until all required improvements are completed.
