A. The building official and any building inspector, acting in good faith and without malice in the discharge of his or her duties, shall not be rendered personally liable for damages that may accrue to persons or property as a result of an act or omission in the discharge of such duties.
B. Except as otherwise provided by law, a suit brought against the building official or building inspector because of an act or omission performed by the building official or building inspector in the enforcement of the provisions of construction codes, or other pertinent laws or ordinances implemented through the enforcement of such codes, shall be defended by Draper City until final termination of such proceedings, and any judgment resulting therefrom shall be assumed by Draper City.
