The building official shall perform all the duties set forth in the construction codes and any other duties as the city council may from time to time provide, including, but not limited to, the following:
A. Administration: The building official shall administer the provisions of the construction codes and this title.
B. Enforcement: The building official shall enforce the provisions of the construction codes and this title. For such purposes, the building official shall have the powers of a law enforcement officer.
C. Interpretation: The building official shall interpret the provisions of the construction codes and may recommend adoption and undertake enforcement of rules and regulations supplemental to such provisions as may be necessary.
D. Permits: The building official shall receive and review all applications for permits required by the provisions of the construction codes and this title, shall determine whether such applications conform with the construction codes, and shall issue permits accordingly.
E. Inspections: The building official shall inspect all buildings and structures as required by the provisions of the construction codes and this title to ensure that the construction, alteration, or repair conforms to the approved plans, specifications and provision of the construction codes.
F. Certificates: The building official shall issue all certificates of occupancy or final inspection required by the provisions of the construction codes and this title.
G. Assistants: The building official may recommend to the city manager the hiring of, or contracting for, technical officers, inspectors, and other employees.
H. Right Of Entry: The building official may enter a building or structure at any reasonable time to make an inspection, to enforce any of the provisions of the construction codes, or when the building official has reasonable cause to believe that there exists in any building or upon a premises a condition which is contrary to or in violation of such codes which makes the building or premises unsafe, dangerous or hazardous. If such building or premises is occupied, the building official must present his or her credentials to the occupant and request entry. If such building or premises is unoccupied, the building official must make a reasonable effort to locate the owner or other persons having charge or control of the building or premises and request entry. In any case where entry is refused, the building official shall have recourse through remedies provided by law to secure entry.
I. Stop Orders: When work is being done contrary to the provisions of the construction codes, or any other rules or regulations adopted pursuant thereto, the building official may order the work stopped by serving written notice on any person engaged in the doing or causing such work to be done. Upon receipt of notice, such persons shall forthwith stop the work until authorized by the building official to proceed.
J. Occupancy Violations: When a building, structure or building service equipment therein is being used contrary to the provisions of the construction codes, the building official may order such use discontinued by serving written notice on any person causing such use to be continued. Upon receipt of notice, such person shall discontinue the use within the time prescribed by the building official.
K. Disconnect Utilities: The building official shall have the authority to disconnect a utility service or energy supply to a building, structure or building service equipment where necessary to eliminate an immediate hazard to life or property. The building official shall, whenever possible, notify the serving utility, the owner and occupant of the building, structure or building service equipment of the decision to disconnect prior to taking such action, and shall notify such serving utility, owner and occupant of the building, structure or building service equipment, in writing, of such disconnection immediately thereafter.
L. Condemn Building Service Equipment: When the building official ascertains that building service equipment has become hazardous to life, health or property, or has become unsanitary, the building official shall order in writing that such equipment either be removed or restored to a safe or sanitary condition, as appropriate. The written notice itself shall fix a time limit for compliance with such order. Defective building service equipment shall not be maintained after receiving such notice.
When equipment or installation is to be disconnected hereunder, written notice of such disconnection and causes therefor shall be given within twenty four (24) hours after disconnection to the serving utility, the owner and occupant of such building, structure or premises.
M. Connection After Order To Disconnect: No person shall make connections from an energy, fuel or power supply, nor supply energy or fuel to building service equipment which has been disconnected or ordered to be disconnected by the building official, or the use of which has been ordered to be discontinued by the building official, until the building official authorizes the reconnection and use of such equipment.
N. Institute Action: When any construction work, building or service equipment is maintained in violation of the construction codes or in violation of a notice issued pursuant to the provision of this section, the building official shall, upon approval from the community development director and the city manager, institute appropriate action to prevent, restrain, correct or abate the violation.
O. Investigate Violations: The building official shall conduct investigations and prepare reports as required by Utah Code Annotated section 58-56-8, as amended, upon a finding that a licensed contractor, electrician, or plumber has materially violated the provisions of a code in a manner to jeopardize the public health, safety and welfare.
