9-7-070: NONCONFORMING USE AS AFFIRMATIVE DEFENSE:
It shall be an affirmative defense to the enforcement of the provisions of this title that the action complained of is a legally nonconforming lot, structure, or use as set forth in chapter 22 of this title. The property owner shall have the burden of establishing that a nonconforming lot, structure, or use lawfully exists under this title. (Ord. 394, 8-7-2001)
