A. Removal Of Property; Injury: It is unlawful for any person to remove any headstone, tombstone, monument, grave decoration, tree, shrub, or any other property in any cemetery, except with permission of the city. It is unlawful for any person to maliciously injure, deface, break or destroy property in the city cemetery.
B. Markers, Monuments: All markers and monuments shall be placed in any cemetery in accordance with the applicable rules and regulations adopted from time to time by the city council. No person shall install any marker or monument without permit from the city.
C. Additional Rules: The city council may adopt by resolution all other rules for the care, use, operation and maintenance of the city cemetery as are reasonable and necessary, including, but not limited to, rules concerning traffic, hours, and decoration.
D. Disturbing Behavior: No person shall knowingly or intentionally engage in behavior that is reasonably calculated to inflict severe emotional distress on any member of a funeral within one hundred feet (100') of the funeral, or if using amplification devices, within one hundred fifty feet (150') of the funeral.
E. Disruptions: No person shall knowingly or intentionally disrupt a funeral by obstructing a mourner's entry or exit to or from funeral services, cemetery, or grave site.
F. Violation; Penalty: Violation of the provisions of this section shall be a class B misdemeanor. (Ord. 728, 11-21-2006)
