The cemetery committee shall be appointed by the city manager for the general supervision of the city cemetery. The city recorder shall chair the cemetery committee and administer the rules.
A. The cemetery committee shall:
1. Direct and control all improvements, planting, placement of markers, monuments and all other work done within the cemetery of any kind, nature, or description;
2. Direct and control all burials in the city cemetery;
3. Sell burial rights in any unsold lots in the city cemetery and issue any payment to the city treasurer; and
4. Provide for the regulation of all funeral corteges while in the cemetery.
B. Before issuing a written permit to inter remains in the cemetery, the cemetery committee shall require proof of right of burial certificate and the payment of all fees.
C. A certificate of burial right shall comply with such rules, regulations and terms adopted by the city council pertaining to the sale, transfer, and usage of burial rights, as well as the size of grave and location in the cemetery.
D. A right to burial certificate does not convey to or entitle the holder thereof any other privilege other than the right to bury remains of a deceased person in an available grave as determined by the city. A right to burial certificate does not convey any title to the land or any part thereof.
E. The cemetery committee shall keep record of all certificates conveyed, burials and removals, plats and locations. The city recorder shall submit all information required to Salt Lake County, as provided under Utah Code Annotated Title 8, Chapter 3, as amended. (Ord. 728, 11-21-2006; amd. Ord. 1627, 12-3-2024)
Unless a burial complies with the provisions in this chapter, it shall be unlawful for any person to:
A. Bury remains of a deceased person within the limits of the city
B. Bury remains of a non-cremated deceased person in any cemetery without first placing the remains in a casket or other suitable container encased in a vault of concrete, metal, fiberglass, or other materials of equivalent strength (not wood), approved by the city and so constructed as to prevent collapse and the resulting settlement of the soil above the same. A. It shall be unlawful for any person to disinter any remains in the city cemetery except in accordance with state law. Before disinterment the requester shall provide a fee as determined by the city council by resolution and a written order from the estate of the deceased authorizing such removal, which order shall be filed and preserved by the city recorder.
B. No remains shall be removed where the person has died of a contagious disease within two (2) years of the date of burial, unless the remains were cremated or buried in a hermetically sealed coffin, which is still intact. (Ord. 728, 11-21-2006; amd. Ord. 1627, 12-3-2024)
