7-11-090: CONTAINERS:
A.   Placement In Containers Required: All residential refuse and recyclable items to be collected by the city from each residential user shall be placed only in the appropriate automated refuse container or automated recycling container issued to such residential user. Use of containers issued to other residents for waste disposal is prohibited.
B.   Title To Containers: Title to the automated refuse and recycling containers furnished by the city shall be retained by the city.
C.   Maintenance: Residents shall not add destructive or decorative markings to or alter the original color of automated refuse or recycling containers.
D.   Damages: Residents shall be liable for damage to automated refuse or recycling containers caused by placing any of the following in the automated refuse or recycling container:
1.   More than three hundred (300) pounds of material;
2.   Hot materials;
3.   Corrosive materials; or
4.   Any other solid waste, material, or substance that cuts, melts, or ignites the container.
E.   Report Of Damage, Malfunction: Residents shall promptly report to the city any damage to or malfunctioning of an automated refuse or recycling container that limits its usefulness for receipt of refuse/recyclable items so that it may be repaired or replaced.
F.   Replacement Of Lost Containers: Automated refuse or recycling containers lost or missing through no fault of the resident shall be replaced without charge. Residents shall exercise due care to protect the automated refuse and recycling containers against loss through theft or misappropriation.
G.   Nontransferable: Automated refuse or recycling containers furnished by the city are issued to specific residential addresses and are nontransferable. Upon discontinuance of use by a resident, the automated refuse and recycling container(s) assigned to that address shall remain at the property unless collected by the city.
H.   Overfilling; Rainproof, Flyproof: Automated refuse or recycling containers shall not be overfilled to the extent that the contents may be spilled during collection. All commercial solid waste shall be placed in rainproof and flyproof receptacles and the receptacles shall be tightly closed. (Ord. 1401, 9-24-2019)
