The City shall defend and pay any judgment incurred by a City elected official, volunteer, employee, or contractor holding the position of City Engineer, City Attorney, or City Justice Court Judge as herein provided or otherwise required by law. The official, volunteer, employee or contractor must submit a signed and completed written request and agreement with the City Manager within ten (10) days after service of process upon the officer or employee requesting such defense. The City's liability hereunder extends only to acts or omissions occurring during performance of the official's, volunteer's, employee's or contractor's duties as prescribed for his or her position, occurring during the scope of his or her employment or under the color of authority.
