CHAPTER 131: OFFENSES AGAINST PUBLIC ORDER

§ 131.01 ACTS PROHIBITED AT NIGHT.
   (A)   Rules and regulations of cemeteries are adopted by resolution for use, care, control, management, restriction and protection of both the North and East Municipal Cemeteries.
   (B)   Between the hours of 30 minutes after sunset and 6:00 a.m. of the succeeding day, no person shall be in a city park unless driving, bicycling, walking or otherwise moving through the park on lawful business within a public street right-of-way or officially designated bicycle path or sidewalk, or authorized to be in the park by the City Administrator or the City Administrator’s designee.
   (C)   For the purpose of this section, CITY PARK is defined to be Anna Drain Park and swimming pool area, the City Civic Center area and the Grant Levins Pavilion and Covered Bridge areas.
   (D)   Upon finding it to be in the public interest and consistent with city goals and policies, the City Council may, by motion, exempt a special event from the prohibitions of division (B) above. The motion shall specify the period of time and the location covered by the exemption.

§ 131.02 JUVENILE CURFEW; EXCEPTIONS.
   (A)   (1)   No minor shall be in or upon any street, highway, park, alley or other public place between the hours of 11:00 p.m. and 4:00 a.m. of the following morning.
      (2)   This section does not apply to a minor who is:
         (a)   Accompanied by the minor’s parent or guardian;
         (b)   On an errand at the direction of the minor’s parent or guardian, without any detour or stop;
         (c)   In a motor vehicle involved in interstate travel;
         (d)   Engaged in an employment activity, or going to or returning home from an employment activity, without any detour or stop;
         (e)   Involved in an emergency;
         (f)   On die sidewalk abutting the minor’s residence or abutting the residence of a next-door neighbor if the neighbor did not complain to the police department about the minor’s presence;
         (g)   Attending an official school, religious, or other recreational activity supervised by adults and sponsored by the city, a civic organization, or another similar entity that takes responsibility for the minor, or going to or returning home from, without any detour or stop, an official school, religious, or other recreational activity supervised by adults and sponsored by the city, a civic organization, or another similar entity that takes responsibility for the minor;
         (h)   Exercising First Amendment rights protected by the United States Constitution, such as the free exercise of religion, freedom of speech, and the right of assembly; or
         (i)   Married or had been married or had disabilities of minority removed in accordance with state law.
   (B)   No parent, guardian or person having the care and custody of a minor under the age of 18 years, shall allow such minor to be in or upon any street, highway, park, alley or other public place between the hours specified in division (A) above, except as otherwise provided in division (A) above.
   (C)   Any minor who violates division (A) above may be taken into custody, as provided in O.R.S. 419C.080, 419C.085 and 419C.088, and may be subject to further proceedings, as provided in O.R.S. Chapter 419C.

§ 131.03 LOITERING.
   (A)   Generally.
      (1)   No person shall loiter or prowl in a place, at a time or in a manner not usual for law abiding persons under circumstances that warrant alarm for the safety of persons or property in the vicinity.
      (2)   Among the circumstances which may be considered in determining whether such alarm is warranted is that the person takes flight upon seeing a police officer, refuses to identify himself or herself or manifestly endeavors to conceal himself or herself, or any object.
      (3)   Unless flight by the person or other circumstances make it impracticable, a police officer shall, prior to an arrest for violation of this division (A), afford the person an opportunity to dispel any alarm which would otherwise be warranted, by requesting him or her to identify himself or herself and explain his or her presence and conduct.
      (4)   Failure of a police officer to do so shall be a defense in prosecution under the provisions of this division (A). It shall also be a defense if it appears at trial that the explanation given by the person was true and, if believed by the police officer at the time, would have dispelled the alarm.
   (B)   Near schools and places frequented by children.
      (1)   No person not having any reason or relationship involving custody of or responsibility for a student, or not having written permission from anyone authorized to grant the same shall loiter in or near a school building or grounds.
      (2)   No person shall loiter about a public place frequented by children, including swimming pools, school bus stops, playgrounds and parks and public premises adjacent thereto, for the purpose of annoying, bothering or molesting children.

§ 131.04 SOLICITING AND THE LIKE, DELINQUENT ACTS BY MINOR.
   No person shall solicit, aid, abet or cause a minor under the age of 18 years to:
   (A)   Violate a law of the United States, or of a state, or to violate a city or county ordinance;
   (B)   Do an act which endangers the health, safety or welfare of the minor or of another person; or
   (C)   Run away or conceal himself or herself from a person or institution having lawful custody of the minor.

§ 131.05 IMPEDING PASSAGE.
   No person shall purposely impede the passage of another over a street, sidewalk or other public way.
