A. The terms and conditions of an approved preliminary plat or final plat may only be modified by the city council.
B. Applications to modify terms or conditions shall be filed with the city clerk, along with the applicable fees.
C. Requests for modifications shall be considered by the city council at any regular or special meeting, allowing sufficient time for required public notice.
D. The review and action on the modification shall be in accord with the procedures and standards of the original plat application. The review shall be confined to the proposed modification.
E. Minor modifications to preliminary plats may be considered by the city administrator or city engineer for:
1. Interior lot line locations adjustments;
2. Minor acreage adjustments that do not result in an increase in the number of lots or significantly alter the lot layout;
3. Minor realignments of driveways, paths, or streets;
4. Consolidation of proposed lots to reduce density.
F. The council shall render a decision in writing on the proposed modification after consideration of the application. (Ord. 172, 7-8-2021)
