9-1-12: PENALTY:
   A.   It shall be unlawful for any person to do, or cause or permit to be done, whether acting as principal, agent, or employee, any construction, improvement, enlargement, alteration, repair, placement, demolition, or change of the occupancy of a building or structure, unless otherwise expressly exempt, without first procuring a permit from the City.
   B.   Violations of any provisions of this chapter shall be deemed a misdemeanor, subject to penalties of not more than three hundred dollars ($300.00) or imprisonment for not more than ninety (90) days, or by both fine and imprisonment, as specified in Idaho Code section 39-4126.
   C.   Violations of this title are subject to investigative fees, as set by resolution of the City Council.
   D.   Whenever the building official finds any work regulated by this title is being performed in a manner contrary to code, the building official is authorized to issue a stop work order. Upon notice from the building official that work on any building or structure is being conducted contrary to the provisions of this title or in an unsafe and dangerous manner, such work shall be immediately stopped. The stop work order shall be in writing and shall be posted on the site where the work is being performed or shall be given to the property owner, or to the owner's agent, or to the person doing the work. The order shall state the conditions under which work will be permitted to resume. Any person who continues any work in or about the structure after the stop work order has been issued, unless that person is authorized by the City to remove a violation or unsafe condition, shall be subject to the penalties as prescribed by this title.
   E.   The City or its agents have the right to enter the property that is the subject of a building permit application, upon the receipt of a signed application. (Ord. 154, 12-14-2017, eff. 1-1-2018)
