7-1-1: SUPERVISION:
All public streets, alleys, sidewalks and other public ways shall be under the supervision of the superintendent of public works or his authorized representative. He shall have supervision over all work thereon and the cleaning thereof and shall be charged with the enforcement of all ordinance provisions relating to such public places (except traffic ordinances) and is hereby authorized to enforce such ordinances. 7-1-2: STREET AND SIDEWALK CONSTRUCTION:
   A.   Permit Required: It shall be unlawful to construct or lay any pavement on any public street, sidewalk, alley or other public way, or to repair the same or to construct or change any culverts, drains, or ditches within the right of way of the village, without having first secured a permit therefor. Applications for such permits shall be made to the superintendent of public works and shall state the location of the intended pavement or repair, the extent thereof and the person who is to do the actual construction work. No such permit shall be issued, except on order of the president and board of trustees. (Ord., 7-12-1989; amd. 1997 Code)
   B.   Bond And Insurance:
      1.   Bond: Each applicant shall file a bond in the amount of ten thousand dollars ($10,000.00) with sureties to be approved by the superintendent of public works conditioned to indemnify the village from any loss or damage resulting from the work undertaken or the manner of doing the same.
      2.   Insurance: Each applicant shall further provide evidence of insurance to the village; said certificate of insurance to name the village as an additional party insured and be sufficient to cover all contract work to be performed by the general contractor and any subcontractor and shall be in the following amounts:
         a.   Comprehensive general liability insurance for each occurrence in the sum of one hundred thousand dollars ($100,000.00) and aggregate in the sum of three hundred thousand dollars ($300,000.00).
         b.   Property damage in the amount of one hundred thousand dollars ($100,000.00) for each occurrence.
         c.   Comprehensive automobile liability insurance in the amount of one hundred thousand dollars ($100,000.00) for bodily injury each occurrence and three hundred thousand dollars ($300,000.00) for bodily injury aggregate and one hundred thousand dollars ($100,000.00) property damage for each occurrence.
         d.   Excess umbrella liability in the amount of one million dollars ($1,000,000.00) to cover claims exceeding the above principal coverages; providing, that such excess umbrella coverage shall not be required if the amounts of the comprehensive general liability insurance and the comprehensive automobile liability insurance as set forth in subsections B2a and B2c of this section are increased to the sum of five hundred thousand dollars ($500,000.00) for each occurrence and an aggregate sum of one million dollars ($1,000,000.00).
         e.   Workers' compensation.
         f.   Employer's liability of one hundred thousand dollars ($100,000.00) each accident.
   C.   Specifications: All street and sidewalk pavement shall be made in conformity with the specifications laid down by the president and board of trustees. (1997 Code)
7-1-3: REPAIRS AND DEFECTS:
   A.   Repairs: All public street, alley and sidewalk pavements shall be in good repair. Such repair work, whether done by the village or the abutting owner, shall be under the supervision of the superintendent of public works.
   B.   Defects: It shall be the duty of every village officer or employee becoming cognizant of any defect in any street, alley or sidewalk, or any obstruction thereof, to report the same to the superintendent of public works or his authorized representative as soon as possible. (1997 Code)
7-1-4: BARRICADES:
   A.   Barricades Required:
      1.   Any person laying or repairing any pavement on a street, sidewalk or other public place or making an excavation in the same shall maintain suitable barricades to prevent injury of any person or vehicle by reason of the work; such barricades shall be protected by suitable lights at nighttime.
      2.   Any defect in any such pavement shall be barricaded to prevent injury, and any person properly maintaining any opening or excavation in any such place shall guard such opening or excavation while the same remains open by proper barricades and lights.
   B.   Disturbing Barricades: It shall be unlawful to disturb or interfere with any barricade or lights lawfully placed to protect or mark any new pavement or excavation or opening in any public street, alley or sidewalk. (1997 Code)
7-1-5: EQUIPMENT:
   A.   Equipment Requirements:
      1.   Unsafe Vehicle: It is unlawful for any person to drive or move, or for the owner to cause or knowingly permit to be driven or moved on any highway any vehicle or combination of vehicles which is in an unsafe condition as to endanger any person or property, or which does not contain those parts or is not at all times equipped with the lamps and other equipment in proper condition and adjustment as required in 625 Illinois Compiled Statutes 5/12-101 et seq., or which is equipped in any manner in violation of 625 Illinois Compiled Statutes 5/12-101 et seq., or for any person to do any act forbidden or fail to perform any act required under 625 Illinois Compiled Statutes 5/12-101 et seq.
      2.   Exceptions: The provisions of 625 Illinois Compiled Statutes 5/12-101 et seq., with respect to equipment on vehicles shall not apply to implements of husbandry, road machinery, road rollers, or farm tractors, or to farm-wagon type trailers having a fertilizer spreader attachment permanently mounted thereon, having a gross weight of not to exceed thirty six thousand (36,000) pounds and used only for the transportation of bulk fertilizer, or to farm-wagon type tank trailers of not to exceed two thousand (2,000) gallons' capacity, used during the liquid fertilizer season as field storage nurse tanks, supplying the fertilizer to a field applicator and only for bringing the fertilizer to a field applicator from a local source of supply to the farm or field or from one farm or field to another.
   B.   Size, Weight, And Load Regulations:
      1.   It is unlawful for any person to drive or move on, upon, or across, or for the owner to cause to knowingly permit to be driven or moved on, upon, or across any highway, street, or alley any vehicle or vehicles of a size or weight to exceed thirty six thousand (36,000) pounds, or otherwise in violation of 625 Illinois Compiled Statutes 5/15-101 et seq.
      2.   The provisions of 625 Illinois Compiled Statutes 5/15-101 et seq., governing size, weight, and load do not apply to fire apparatus or equipment for snow and ice removal operations owned or operated by the village, or to implements of husbandry temporarily operated or towed in a combination upon a highway provided such combination does not consist of more than three (3) vehicles or, in the case of hauling fresh, perishable fruits or vegetables from farm to the point of first processing, not more than three (3) wagons being towed by an implement of husbandry, or to a vehicle operated under the terms of a special permit.
      3.   No person shall use the highways under the jurisdiction of the village in violation of weight and location restrictions and commercial vehicle restrictions established by the board of trustees.
   C.   Projecting Loads On Vehicles: No vehicle shall be operated on any street with any load carried thereon extending beyond the line of the fenders on the left side of the vehicle nor extending more than six inches (6") beyond the line of the fenders on the right side thereof.
   D.   Protruding Members Of Vehicles: No vehicle with boom, arm, drill rig, or other protruding component shall be operated upon the highway unless the protruding component is fastened so as to prevent shifting, bouncing or moving in any manner.
   E.   Spilling Loads Prohibited:
      1.   No vehicle shall be driven or moved on any street unless the vehicle is so constructed or loaded as to prevent any of its load from dropping, shifting, leaking, or otherwise escaping therefrom, except that sand may be dropped for the purpose of securing traction, or water or other substance may be sprinkled on a roadway in cleaning or maintaining the roadway.
      2.   No person shall operate on any highway any vehicle with any load unless the load and any covering thereon is securely fastened so as to prevent the covering or load from becoming loose, detached or in any manner a hazard to other users of the highway. (1997 Code)
7-1-6: STREET AND SIDEWALK OPENINGS:
   A.   Permit Required: It shall be unlawful to construct or maintain any opening or stairway in any public street, alley, sidewalk or other public place without a permit from the superintendent of public works.
   B.   Openings To Be Guarded: All such lawfully maintained openings shall be guarded by a suitable strong cover or railing to the approval of the superintendent of public works.
   C.   Leaving Cellar Door, Basement Entrance, Vault Open: No person shall leave open or permit to be left open any cellar door, basement entrance, vault, cistern, well, ditch, or other like pit or hole, on or adjoining any street, alley, sidewalk, or other public ground, or on any private property accessible by pedestrians, without securing or protecting the same, so as not to endanger the safety of persons or animals passing thereby from falling therein. Such person shall be liable for all damages or injuries to persons or property arising from any such neglect, and for any damage that may be recovered against the village in consequence thereof. 7-1-7: PROHIBITED ACTS AND CONDITIONS:
   A.   Injury To Pavements: It shall be unlawful to walk upon or drive any vehicle or animal upon or injure any newly laid street or alley pavement while the same is guarded by a warning sign or barricade or to knowingly injure any street, sidewalk or alley pavement.
   B.   Obstructions: It shall be unlawful for any person to cause, create or maintain any obstruction of any street, alley, sidewalk or other public way, except as may be specifically authorized by ordinance or by the superintendent of public works.
   C.   Encroachments: It shall be unlawful to erect or maintain any building or structure which encroaches upon any public street or property.
   D.   Drains: It shall be unlawful to obstruct any drain in any public street or alley. (1997 Code)
7-1-8: DEPOSITS ON STREETS AND SIDEWALKS:
   A.   Streets: It shall be unlawful to deposit on any street any material which may be harmful to the pavement thereof or any waste material or any glass or other articles which may cause injury to any person, animal or property. Aggregate or other materials may be deposited in streets preparatory to delivery for use; provided, that such deposit does not reduce the usable width of the street or roadway at that point to less than eighteen feet (18'); and provided, that such material other than material used in actual building construction shall not be permitted to remain in such street for more than three (3) hours. Any such material shall be guarded by lights if the same remains upon a street after nighttime.
   B.   Sidewalks: It shall be unlawful to deposit on any public sidewalk any material which may be harmful to the pavement thereof or any waste material or any glass or other articles which might cause injury to persons, animals or property. Merchandise or other articles may be deposited on sidewalks preparatory to delivery; provided, that the usable width of the sidewalk is not thereby reduced to less than four feet (4'); and provided, that no such article shall remain for more than one-half (1/2) hour. 7-1-9: TREES AND SHRUBS:
   A.   Property Of Village: All trees, shrubs or other growing vegetation, growing upon the streets, alleys or other public thoroughfares of the village shall be and it is hereby ordained that they are the property of the village, and such rules for the care of same as shall be made from time to time by the president and board of trustees shall be the rules of government and care of said trees, shrubs and other growing vegetation.
   B.   Village Board Control: All trees, shrubs or other growing vegetation adjacent to the streets, alleys or other public thoroughfares of the village, while not the property of the village, shall be under the care and control of the president and board of trustees, and the rules for the care of same shall be applied as in this section provided.
   C.   Interference With Wires; Removal Or Trimming: Whenever any such trees, shrubs or other growing vegetation shall in any way interfere with wires, poles or other equipment of any telephone, telegraph, electric line or other public utility wires or equipment, the same may be ordered removed or trimmed to such height, or will be placed in such condition so that it will cease to be an interference to the equipment aforesaid.
   D.   Abatement Procedure: If at any time any person shall be injured or have cause to have such trees, shrubs or other growing vegetation removed, trimmed or otherwise altered, the procedure for abatement of nuisances, as provided for in title 4, chapter 2 of this code, shall be followed. 7-1-10: PENALTY:
Any person violating any of the provisions of this chapter shall be subject to the penalty provided in section 1-4-1 of this code. (1997 Code)
7-1-11: HOUSE NUMBERS ON ALL BUILDINGS 1 :
The Village hereby adopts the present standards for all residential and commercial building codes as follows:
   A.   All lots, building and structures in the Village shall be numbered in accordance with the plan formulated therefor, approved by the Village Board.
   B.   The Village shall keep a chart showing the proper street number of every lot in the Village, which chart shall be open to inspection by any interested person.
   C.   It shall be the duty of the owner and occupant of every building in the Village to have placed thereon in a place clearly visible from the street, figures at least four (4) inches high showing the number of the building. (Ord. 2020-002, 7-8-2020)
