147.05 COMPENSATORY TIME OFF IN LIEU OF OVERTIME PAY.
   An Employee entitled to overtime compensation under Section 147.04 may elect to take compensatory time off in lieu of the payment of overtime wages. An employee who elects to take compensatory time off in lieu of overtime pay shall be credited with one and one-half hours of compensatory time for each overtime hour worked. Emergency service personnel and other employees who meet the criteria established by the Federal Fair Labor Standards Act may accrue a maximum of 480 hours of compensatory time. All other employees entitled to overtime compensation under Section 147.04 may accrue compensatory time off to a maximum of 240 hours. An employee shall be paid at his or her regular rate of pay for all compensatory time accrued in excess of the maximum accumulations permitted by this section. An employee shall also be paid at his or her regular rate of pay for any compensatory time off that is not used within 180 days after it is credited. In the event a promotion or other change in an employee's status exempts the employee from the overtime compensation requirements of the Federal Fair Labor Standards Act, the employee shall be paid for all accrued but unused compensatory time accumulated to the date of such change in status at the employee's regular rate of pay on the last working day immediately preceding the effective date of the change in status. On termination of municipal employment, an employee with accrued but unused compensatory time shall be paid for that time at the greater of his or her regular rate of pay at the time of separation or his or her average regular rate of pay during the three years immediately preceding the date of separation from the municipal service. Compensatory time off shall be taken at times mutually convenient to the employee and the employee's administrative superior and only after the exercise of such leave has been approved in advance by appropriate supervisory personnel in the manner required by such regulations as may be adopted by the Board of Control.
