147.04 OVERTIME PAY AND “SUNDAY” PAY.
   (a)   An employee who is authorized to be in an active pay status for more than forty hours during a workweek shall be paid one and one-half times his or her regular rate of pay for each hour or portion thereof in excess of forty hours during any workweek and shall be paid two times his or her regular rate of pay for each hour or portion thereof in excess of forty that is worked on the employee's second regularly scheduled weekly day off. No overtime compensation shall be paid pursuant to this section unless:
(1)   The Employee is required by supervisory personnel to be in an active pay status for more than forty hours during the workweek; or
(2)   The Employee's performance of work at times other than his or her regularly scheduled working hours is authorized in writing by the head of the department responsible for the completion of the tasks assigned to the Employee.
   (b)   No overtime compensation shall be paid pursuant to this section to any official or employee meeting the criteria for exemption from the payment of overtime compensation established by the Federal Fair Labor Standards Act of 1938 (29 U.S.C.A. 207, 213), as amended, and the Ohio Minimum Wage Standards (ORC Chapter 4111), as amended.
   (c)   Compensation for overtime shall be paid no later than at the conclusion of the next succeeding pay period.
