927.14 CRIMINAL PENALTIES.
   (a)   Installation of an illegal connection to the MS4 in violation of Section 927.05(a) shall be punishable as a Misdemeanor of the Second Degree. If the offender is a licensed plumber registered to engage in business in the City of Defiance, conviction of the offense may be deemed adequate grounds upon which to revoke the offender's registration. If the offender has previously been convicted of a violation of Section 927.05(a), conviction shall result in revocation of the offender's registration. No person whose registration is revoked in compliance with this Section shall be again registered within one year following the date of revocation.
   (b)   Maintenance or use of an illegal connection in violation of Section 927.05(b) by any person having knowledge of the illegality or being reckless in that regard shall be punishable as a Misdemeanor of the Second Degree.
   (c)   Maintenance or use of an illegal connection in violation of Section 927.05(b) by any person who has been served with a Notice of Violation requiring removal of the connection as a remedial action after the date on which the offender has been Ordered to complete the removal, or such later date as may be established by the determination issued upon Appeal of that Notice, shall be punishable as a misdemeanor of the first degree. If the offender has been previously convicted of a violation of Section 927.05(b) predicated on the maintenance or use of the same connection, the trial Court shall sentence the offender to a term of not less than 3 days actual incarceration and impose a fine of not less than $500.00.
 
   (d)   Reckless to promptly report the occurrence or suspected occurrence of a spill or other release of a hazardous material in quantities sufficient to threaten the occurrence of an illicit discharge failure by any person required by Section 927.07(b) to notify public authorities shall be punishable as a misdemeanor of the first degree.
 
   (e)   Negligent failure to provide the City Administrator with the notice required by Section 927.05(c) or (d) by any person required by those sections to provide such notice shall be punishable as a minor misdemeanor.
