1133.09 FOOD TRUCK REGULATIONS.
   The regulation set forth in this Section shall apply to both individual food trucks and food truck parks located in the R-1, R-2, PR, RNC, PO, MUB, Commercial PUD zoning districts, unless stated otherwise. Each operator of a food truck shall obtain a Zoning Permit approval and Certificate of Occupancy, renewable on an annual basis.
   (a)   Only food and non-alcoholic beverages shall be sold, unless associated with an approved limited special event.
   (b)   A food truck shall be licensed on an annual basis and shall be allowed to operate 365 days a year, in RNC, PO, MUB, Commercial PUD. A food truck located in an R-1, R-2 and PR zoning district will be limited to no more that one day per event.
   (c)   The hours of operation shall be between 7:00 a.m. and 10:00 p.m.
   (d)   A food truck shall not impede the safe movement of vehicular and pedestrian traffic, parking lot circulation or access to any public alley or sidewalk.
   (e)   A food truck shall not provide amplified music.
   (f)   No food truck shall place signs/banners in or alongside the public right-of-way or across roadways unless permitted by this Section. Signs must be permanently affixed to or painted on the food truck or in the case of a mobile retail food establishment, attached directly to the table, awning, canopy or similar item upon or under which sales are directly made; no freestanding signage.
      (1)    Menu Boards. An A-frame menu board is permitted to be placed by the food truck vendor operation and within the vending area. An operation is allowed to display this sign only during hours of operation, otherwise the board shall be removed. The sign shall not exceed thirty (30) inches in width and forty-eight (48) inches in height.
      (2)    A designated food truck park may be permitted one ground mounted sign consistent with the applicable sign requirements for the RNC, PO, MUB, Commercial PUD zoning district.
   (g)   A food truck shall be attended at all times during the permitted hours of operation.
   (h)   A food truck shall provide separate and clearly marked receptacles for trash and recycling.
   (i)   No food truck shall cause any liquid wastes used in the operation to be discharged.
   (j)   Setbacks. The following minimum setbacks shall apply to food truck:
      (1)    A minimum setback of seventy-five (75) feet from the front door of any restaurant and/or outdoor dining area.
      (2)    A minimum setback of fifty (50) feet from any permitted food truck.
      (3)    A minimum setback of fifteen (15) feet from any fire hydrant.
      (4)    A minimum setback of ten (10) feet away from any driveway, sidewalk, utility box or vault, handicapped ramp, building entrance or exit.
   (k)   A food truck and the area serving the operation shall be located upon an asphalt or concrete surface. No food truck shall be located in the public right-of-way, in any driveway aisle, any parking zone, any loading area, or any parking lane.
   (l)   Adequate lighting of the entire surface area serving the food truck area shall be provided. The outdoor lighting standards set forth in Section 1139.05 shall apply.
   (m)   Exceptions to these Food Truck Regulations.
      (1)    Food Trucks for Special Events. Limited duration special events featuring one or more food trucks or other food vendors may have one or more of these standards waived or modified by the City Manager.
      (2)    Mobile food vendors that operate exclusively within public rights of way that do not park or stand at one location, such as an Ice Cream Truck, provided that the vehicle is properly licensed and inspected shall be exempt from these standards.
