(a) In the construction of this Code and all ordinances the following rules of construction and definitions shall be observed unless inconsistent with the manifest intent of the President and the Board or the context clearly requires otherwise:
(1) And/or means and may be read or and or may be read and if the sense requires it.
(2) Board means the Board of Trustees of the Village of Deerfield.
(3) Bond means an obligation in writing, binding the signatory to pay a sum certain upon the happening or failure of an event.
(4) Building means any structure intended to have walls and a roof.
(5) Business means any profession, trade, occupation and any other commercial enterprise conducted for monetary reward.
(6) Clerk means the Village Clerk.
(7) Computation of time. The time within which an act is to be done shall be computed by excluding the first but including the last day, and if the last day be a Saturday, Sunday or legal holiday, the time runs until the end of the next day which is neither a Saturday, Sunday or legal holiday.
(8) County means the Counties of Cook and/or Lake.
(9) Dealer (Wholesaler and Retailer). Wholesaler relates to the sale of goods, merchandise, articles or things in quantity to persons who purchase for the purpose of resale, as distinguished from a retail dealer who sells in smaller quantities direct to the consumer.
(10) Definitions given within a Chapter or Article apply only to words or phrases used in such Chapter or Article unless otherwise provided.
(11) Designee, following an official of the Village, means the authorized agent, employee or representative of such official.
(12) Gender: Words used in any Section importing the masculine gender shall include the feminine and neuter as well as the masculine.
(13) Governing Body means the Board of Trustees. By ordinance there is established the office of Village Manager who is granted substantial powers of administration.
(14) Health Officer means the Health Officer having jurisdiction within the Village.
(15) Joint authority means the authority given to several persons or officers. Such authority vests in a majority of such persons or officers.
(16) Keeper means one in possession of or who has the care, custody or superintendence of a thing, place or business whether or not the owner or proprietor, and includes any person, firm, association, corporation, club and co- partnership whether acting by themselves or by a servant, agent or employee.
(17) May: The word may is permissive and discretionary.
(18) Mayor means the Mayor of the Village who is the same person and may also be referred to as the President of the Board of Trustees.
(19) Month means a calendar month unless otherwise expressed.
(20) Number: Words used in the singular include the plural and the plural includes the singular number.
(21) Oath shall be construed to include an affirmation in all cases in which, by law, an affirmation may be substituted for an oath and in such cases the words "swear" and "sworn" shall be equivalent to the words "affirm" and "affirmed".
(22) Occupant means tenant or person in actual possession.
(23) Operate means carry on, keep, conduct, maintain, manage, direct or superintend.
(24) Ordinances mean the ordinances of the Village of Deerfield and all amendments and supplements thereto.
(25) Owner means one who has complete dominion over particular property and who is the one in whom legal or equitable title rests; when applied to a building or land, owner means any part owner, joint owner, owner of a community or partnership interest, life tenant, tenant in common, joint tenant or tenant by the entirety of the whole or part of such building or land.
(26) Person means any individual, natural person, joint stock company, partnership, voluntary association, society, club, firm, company, corporation, business trust, organization, or any other group acting as a unit, or the manager, lessee, agent, servant, partner, member, director, officer or employee of any of them including an executor, administrator, trustee, receiver, or other representative appointed according to law.
(27) Personal Property means any money, goods, movable chattels, things in action, evidence of debt, all objects and rights which are capable of ownership, and every other species of property except real property.
(28) Preceding and Following mean next before and next after, respectively.
(29) Property. The word property shall include real and personal property.
(30) Proprietor means an owner of the property or premises including any person, firm, association, corporation, club, partnership or other group acting as a unit whether acting by themselves or by a servant, agent or employee.
(31) Public place means any park, lake, stream, stadium, athletic field, playground, school yard, street, boulevard, avenue, alley, plaza, square, bus, train, or railroad depot, station, terminal, cemetery, open space adjacent thereto, all beaches, canals or other waterways, grounds and buildings or any other place commonly open to the public.
(32) Real Property means land, together with all things attached to the land so as to become a part thereof.
(33) Registered mail. The word registered mail shall include certified mail with return receipt requested.
(34) Residence. The place adopted by a person as his habitation, and to which, whenever he is absent, he has intention of returning. When a person eats at one place and sleeps at another, the place where such person sleeps shall be deemed his residence.
(35) Shall. The word shall is mandatory.
(36) Sidewalk. That portion of a street between the curb line and the adjacent property along the margin of the street or other highway, designed, constructed and intended for the use of pedestrians to the exclusion of vehicles.
(37) Signature and subscription. The name of a person mark or symbol appended by him to a writing with intent to authenticate the instrument as one made or put into effect by him.
(38) State. The State of Illinois.
(39) Statutes or Compiled Statutes or S.H.A. The latest published edition of the Statutes or Compiled Statutes or S.H.A. of Illinois.
(40) Street. Any public way, road, highway, street, court, avenue, boulevard, parkway, alley, lane, viaduct and bridge.
(41) Tense. Words used in the past or present tense include the future as well as the past and present.
(42) Village. The Village of Deerfield in the Counties of Cook and/or Lake, State of Illinois, except as otherwise provided.
(43) Village Limits. Within the Village and includes not only the corporate limits of the Village, but also any property which it owns or which is under its jurisdiction.
(44) Village President. The President of the Board of Trustees who also may be referred to as the Mayor of the Village.
(45) Written or in writing. Shall be construed to include any representation of words, letters or figures whether by printing, mimeographing or otherwise.
