ORDINANCE NO. 0-76-48
AN ORDINANCE ADOPTING AND ENACTING A NEW CODE OF ORDINANCES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS; ESTABLISHING THE SAME; PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN, EXCEPT AS HEREIN EXPRESSLY PROVIDED; PROVIDING FOR THE MANNER OF AMENDING SUCH CODE OF ORDINANCES; PROVIDING FOR A PENALTY FOR THE VIOLATION THEREOF; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION ONE: That this Code, consisting of Chapters 1 through 23, inclusive, and printed and published in book form, is hereby adopted and enacted as the "Municipal Code of the Village of Deerfield, Illinois", and shall be treated and considered as a new and original comprehensive Code which shall supersede all other general and permanent ordinances passed by the President and Board of Trustees on or before March 25, 1976, except such as by reference thereto are expressly saved from repeal or continued in force and effect for any purpose.
SECTION TWO: That all ordinances of a general and permanent nature of the Village of Deerfield, enacted on final passage on or before March 25, 1976, and not in such Code, or recognized and continued in force by reference therein, are hereby repealed from and after the effective date of such Code, except as hereinafter provided.
SECTION THREE: That the repeal provided for in Section Two hereof shall not affect any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of such Code; nor shall such repeal affect any of the following Codes or ordinances which are not contained in such Code and which shall be excluded from inclusion therein and remain in full force and effect:
Ordinances relating to annexations and boundaries
Franchise ordinances
Contract ordinances and ordinances authorizing the execution of a contract
Ordinances vacating, dedicating, widening, paving, naming or changing the names of streets, alleys, parks or public ways
Ordinances fixing the grades of streets, curbs and sidewalks
Ordinances relating to the leasing, transfer, acceptance, sale or purchase of real estate or personal property by or from the Village
Bond ordinances and ordinances pertaining to Village indebtedness
Ordinances providing or guaranteeing the payment of money
Ordinances relating to special assessment and special taxation proceedings
Appropriation, budget and tax levy ordinances
Ordinances fixing salaries of officers, employees and appointees
Ordinances establishing personnel rules and regulations and all other administrative ordinances or resolutions of the President and Board of Trustees not in conflict or inconsistent with the provisions of this Code
Ordinances regarding the establishment of Village tax rates
The Zoning Ordinance and amendments thereto
The Ordinance adopting an official Comprehensive Plan for the Village
The Subdivision Control Ordinance and amendments thereto
The Building Codes and amendments thereto
The Plumbing Code and amendments thereto
The Electrical Code and amendments thereto
The Fire prevention and Life Safety Codes
Ordinances pertaining to the condemnation and the disconnection of property
Ordinances concerning the investment of surplus funds or designating a depository for Village funds
Ordinances pertaining to the authorization of motor fuel tax, and Federal revenue sharing expenditures and improvements
Ordinances accepting any plan or subdivision in the Village or approving any planned unit development
Ordinances pertaining to the regulation of Burglar and Holdup Alarm Businesses, Systems and Uses
SECTION FOUR: That any and all additions or amendments to such Code, when passed in such form as to indicate the intention of the President and Board of Trustees to make the same a part thereof, shall be deemed to be incorporated in such Code so that reference to the "Municipal Code of the Village of Deerfield, Illinois", shall be understood and intended to include such additions and amendments.
SECTION FIVE: That a copy of such Code shall be kept on file in the office of the Village Clerk, preserved in looseleaf form. It shall be the express duty of the Village Clerk, or someone authorized by her, to insert in their designated places all amendments or ordinances which indicate the intention of the President and Board of Trustees to make the same a part of such Code when the same have been printed or reprinted in page form, and to extract from such Code all provisions which may from time to time be repealed by the President and Board of Trustees. This copy of such Code shall be available for all persons desiring to examine the same and shall be considered the official Municipal Code of the Village of Deerfield, Illinois.
SECTION SIX: Whenever in such Code any act is prohibited or is made or declared to be unlawful or a misdemeanor or a violation of such Code, or whenever in such Code the doing of any act is required or the failure to do any act is declared to be unlawful or a misdemeanor or a violation of such Code, where no specific penalty is provided therefor, the violation of any such provision of this Code shall be punished by a fine of not more than five hundred dollars ($500.00). Each day any violation of any provision of this Code shall continue shall constitute a separate offense.
SECTION SEVEN: That in case of the amendment of any section of such Code for which a penalty is not provided, the general penalty as provided in Section Six of this ordinance and Section 1.25 of such Code shall apply to the section as amended or in case such amendment contains provisions for which a penalty, other than the aforementioned general penalty is provided in another section in the same chapter, the penalty so provided in such other section shall be held to relate to the section so amended, unless such penalty is specifically repealed therein.
SECTION EIGHT: That it shall be unlawful for any person, firm or corporation in the Village to change or amend by additions or deletions any part or portion of such Code, or to insert or delete pages or portions thereof, or to alter or tamper with such Code in any manner whatsoever which will cause the law of the Village of Deerfield to be misrepresented thereby. Any person, firm or corporation violating this Section shall be punished as provided in Section 1.25 of the Municipal Code of the Village of Deerfield, Illinois.
SECTION NINE: That all ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.
SECTION TEN: That this ordinance and the Code adopted by same shall be in full force and effect from and after its passage and approval in accordance with law, as printed and published in book form by order of the President and Board of Trustees.
