(a) The following words and phrases when used in this Chapter shall, for the purpose of this Chapter have the meanings respectively ascribed to them in this Chapter, except when the context otherwise requires and except where another definition set forth in another Article of this Chapter and applicable to that Article or a designated part thereof is applicable.
(1) Alley. A public way within a block, generally giving access to the rear of lots or buildings and not used for general traffic circulation. (M.C. 1963, § 20.101)
(2) Bicycle. Every device propelled by human power upon which any person may ride, having two (2) tandem wheels, either of which is sixteen inches (16") or more in diameter. (Ord. 0-77-65, 10-17-77)
(3) Bus. Every motor vehicle designed for carrying more than ten (10) passengers and used for the transportation of persons; and every motor vehicle, other than a taxicab, designed and used for the transportation of persons for compensation, including all such vehicles owned or operated by or for a public or governmental agency or by or for a private or religious organization for the transportation of pupils in connection with any school activity.
(4) Business district. The territory contiguous to and including a highway when within any six hundred feet (600') along such highway there are buildings in use for business or industrial purposes, including but not limited to hotels, banks or office buildings, railroad stations and public buildings which occupy at least three hundred feet (300') of frontage on one side or three hundred feet (300') collectively on both sides of the highway and including territory zoned and developed as a business district under the Deerfield Zoning Ordinances.
(5) Crosswalk.
(A) That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway;
(B) Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface placed in accordance with the provisions of the State Sign Manual.
(6) Driver. Every person who drives or is in actual physical control of a vehicle.
(7) Emergency vehicle. Police vehicles, vehicles of the Fire Department, ambulance, vehicles carrying a State, County or Municipal officer or employee in response to an emergency call and emergency vehicles of public service corporations on an emergency call.
(8) Explosives. Any chemical compound or mechanical mixture that is commonly used or intended for the purpose of producing an explosion and which contains any oxidizing and combustive units or other ingredients in such proportions, quantities or packing that an ignition by fire, by friction, by concussion, by percussion or by detonator of any part of the compound or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous pressures are capable of producing destructive effects on contiguous objects or destroying life or limb.
(9) Flammable liquid. Any liquid which has a flash point of seventy degrees (70o) Fahrenheit, determined by a tagliabue or equivalent closed-cup test device.
(10) Highway. The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
(11) Intersection.
(A) The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two (2) highways which join one another at, or approximately at, right angles or the area within which vehicles traveling upon different roadways joining at any other angle may come in conflict.
(B) The junction of an alley with a street or highway does not constitute an intersection.
(12) Laned roadway. A roadway which is divided into two (2) or more clearly marked lanes for vehicular traffic.
(13) Loading zone. The space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.
(14) Merging traffic. A maneuver executed by the drivers of vehicles on converging roadways to permit entry into the junction thereof, wherein the driver of each vehicle involved is required to adjust his vehicular speed and lateral position so as to avoid a collision with any other vehicle.
(15) Motor vehicle. Every vehicle which is self-propelled.
(16) Motorcycle. Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on nor more than three (3) wheels in contact with the ground, but excluding a tractor.
(17) Official traffic-control devices. All signs, signals, markings and devices which conform with the State Manual and not inconsistent with this Code placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning or guiding traffic.
(18) Owner. A person who holds legal title of a motor vehicle, or in the event a motor vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, or in the event a mortgagor of such motor vehicle is entitle to possession, then such conditional vendee or lessee or mortgagor shall be deemed the owner for the purpose of this Code.
(19) Park or parking. Means the standing of a vehicle, whether occupied or not, otherwise than when temporarily and actually engaged in loading or unloading merchandise or passengers.
(20) Pedestrian. Any person afoot.
(21) Person. Every natural person, firm, copartnership, association or corporation.
(22) Pneumatic tire. Every tire in which compressed air is designed to support the load.
(23) Police officer. Every officer authorized to direct or regulate traffic or to make arrests for violations of traffic regulations.
(24) Private road or driveway. Every way or place in private ownership and used for vehicular travel by the owner and those having express or implied permission from the owner, but not by other persons.
(25) Railroad signs or signal. Any sign, signal, or device other than an official traffic control device erected in accordance with the laws governing same and intended to give notice of the presence of railroad tracks or the approach of a railroad train.
(26) Railroad train. A steam engine, electric or other motor, with or without cars coupled thereto, operated upon rails, except streetcars.
(27) Recreational vehicle. Every vehicle originally designed or permanently converted and used for living quarters or for human habitation and not used as a commercial vehicle, including any house car, house trailer, camper or private living coach.
(28) Residence district. The territory contiguous to and including a highway not comprising a business district when the property on such highway for a distance of 300 feet or more is in the main improved with residences or residences and buildings in use for business, and including territory zoned and developed as a residential district under the Deerfield Zoning Ordinance.
(29) Right-of-way. The right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one grants precedence to the other.
(30) Roadway. That portion of a highway improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder. In the event a highway includes two or more separate roadways the term "roadway" as used herein shall refer to any such roadway separately but not to all such roadways collectively.
(31) Safety zone. The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone.
(32) Semitrailer. Every vehicle without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle.
(33) Sidewalk. That portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines, intended for use of pedestrians.
(34) Stand or standing. Means the halting of a vehicle, whether occupied or not, otherwise than when temporarily and actually engaged in receiving or discharging passengers.
(35) Stop. When required means complete cessation from movement.
(36) Stop or stopping. Means any halting even momentarily of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control sign or signal.
(37) Street. The entire width between boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
(38) Through highway. Every highway or portion thereof on which vehicular traffic is given preferential right of way, and at the entrances to which vehicular traffic from intersecting highways is required by law to yield right of way to vehicles on such through highway in obedience to either a stop sign or a yield sign, when such signs are erected as provided in this Code.
(39) Traffic. Pedestrians, ridden or herded animals, vehicles and other conveyances either singly or together while using any highway for purpose of travel.
(40) Traffic control signal. Any official traffic control device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and permitted to proceed.
(41) Trailer. Every vehicle without motive power in operation, other than a pole trailer, designed for carrying persons or property and or being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle.
(42) Truck. Every motor vehicle designed, used or maintained primarily for the transportation of property.
(43) Urban district. The territory contiguous to and including any street which is built up with structures devoted to business, industry or dwelling houses situated at intervals of less than 100 feet for a distance of a quarter of a mile or more.
(44) Vehicle. Every device, in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power, devices used exclusively upon stationary rails or tracks and snowmobiles.
(45) Yield right-of-way. When required by an official sign means the act of granting the privilege of the immediate use of the intersecting roadway to traffic within the intersection and to vehicles approaching from the right or left, but when the roadway is clear may proceed into the intersection.
