(a) Cannabis: Cannabis includes marijuana, hashish and other substances that are identified as including any parts of the plant Cannabis sativa and including derivatives or subspecies, such as indica, of all strains of cannabis, whether growing or not; the seeds thereof, the resin extracted from any part of the plant; and any compound, manufacture, salt, derivative, mixture or preparation of the plant, its seeds or resin, including tetrahydrocannabinol (THC) and all other naturally produced cannabinol derivatives, whether produced directly or indirectly by extraction; however, “cannabis” does not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture or preparation of the mature stalks (except the resin extracted from it), fiber, oil or cake or the sterilized seed of the plant that is incapable of germination. “Cannabis” does not include industrial hemp as defined and authorized under the Industrial Hemp Act. “Cannabis” also means concentrate and cannabis-infused products.
(b) Violations:
(1) It shall be a violation of this section for any person knowingly to purchase, possess, use, process, transport, grow or consume cannabis except in compliance with the Cannabis Regulation and Tax Act, 410 Illinois Compiled Statutes 705/1 et seq., or Compassionate Use of Medical Cannabis Program Act, 410 Illinois Compiled Statutes 130/1 et seq.
(2) It shall be a violation of this section for any person knowingly to use or consume, or allow someone else to use or consume, cannabis on the premises of any privately owned commercial facility that is open to members of the general public, including, without limitation, retail stores, restaurants, taverns, theaters, and other recreational facilities, except as otherwise specifically permitted pursuant to the Cannabis Regulation and Tax Act and the Compassionate Use of Medical Cannabis Program Act.
(c) Penalty: Any person convicted of any violation of the provisions of this section shall be fined not more than five hundred dollars ($500.00) for each offense. (Ord. 0-76-14, § 1; amd. Ord. 0-19-43, 12-16-2019)
