Sec. 9-17. Notice Inviting Bids; Reservations By The Village:
   (a)   Newspaper: Notice inviting bids shall be published once in at least one newspaper published or of general circulation in the village and at least fifteen (15) days preceding the scheduled bid opening date. The bid opening date shall be no more than forty five (45) days from the date of newspaper publication. The newspaper notice shall include a general description of the article or service to be purchased, shall state where the bid package may be secured, and shall state the time and place for opening bids.
   (b)   Bidders' List: The appropriate department head shall also solicit sealed bids from all responsible prospective suppliers or contractors who have requested their names to be added to a "bidders' list" which the appropriate department head shall maintain in a current format, by sending them a copy of such newspaper notice or such other notice as will acquaint them with the proposed purchase or contract.
   (c)   Bulletin Board: The appropriate department head shall also advertise all pending purchases or bid awards by a notice posted on the public bulletin board in the village hall. (Ord. 0-91-49, 12-2-1991)
   (d)   Refusal To Solicit Or Issue Bids: The village reserves the right to refuse to solicit bids, issue bidding proposals and accept bids from bidders for any of the following reasons:
      (1)   Bidder has previously demonstrated lack of competency and adequate machinery, plant and other equipment.
      (2)   Bidder is performing uncompleted work which, in the judgment of the village, might hinder or prevent the prompt completion of additional work if awarded.
      (3)   Bidder has failed to pay, or satisfactorily settle, all bills due for labor and material on former contracts in force at the time of issuance of proposals.
      (4)   Bidder has defaulted under previous contracts.
      (5)   Bidder has unsatisfactory performance record as shown by past work for the village, judged from the standpoint of workmanship and progress. (1963 Code § 202A; amd. Ord. 0-74-4; Ord. 0-74-41 § 202A)
