(a) No person shall remove, for the purpose of sale, the topsoil of any lot, parcel or tract of ground, in the village, unless a permit shall have first been obtained as hereinafter provided.
(b) Nothing in this section contained shall apply to the removal or excavation of topsoil in connection with any construction or use, made or carried on, upon such premises, pursuant to permits issued by the village manager. (1963 Code § 27.901)
