Sec. 3-25. Purchase Or Acceptance Of Gift Of Liquor By Person Underage; Identification Cards; Exception:
   (a)   Any person to whom the sale, gift or delivery of alcoholic liquor is prohibited because of age shall not purchase or accept a gift of alcoholic liquor or have alcoholic liquor in their possession. (1963 Code § 15.024A)
   (b)   If a licensee or licensee’s agents or employees believes or has reason to believe that a sale or delivery of alcoholic liquor may be prohibited because of the prospective recipient may be under the age of 21, they shall, before making such sale or delivery demand presentation of some form of positive identification, containing proof of age, issued by a federal, state, county, or municipal government, or subdivision or agency thereof, including, but not limited to, a driver’s license, passport, a registration certificate issued under the federal selective service act, or an identification card issued to a member of the armed forces. For the purpose of preventing the violation of this section, any licensee or the licensee’s agent or employee, must refuse to sell or serve alcoholic liquor to any person who is unable to produce adequate written evidence of age and identity.    (c)   No person shall transfer, alter or deface such identification card; use the identification card of another; carry or use a false or forged identification card; or obtain an identification card by means of false information.
   (d)   No person shall purchase, accept delivery or have possession of alcoholic liquor in violation of this section. (1963 Code § 15.024A; amd. Ord. 0-65-43 § 15.024A; Ord. 0-73-59 § 15.024A)
   (e)   The consumption of alcoholic liquor by any person under the age of 21 years is forbidden. (Ord. 0-79-82, 12-17-1979)
   (f)   Notwithstanding anything to the contrary contained in this Section, the possession and dispensing, or consumption by a minor of alcoholic liquor in the performance of a religious service or ceremony, or the consumption by a minor under the direct supervision and approval of the parents or parent of such minor in the privacy of a home, is not prohibited.    (g)   No person shall rent a hotel or motel room from the proprietor or agent thereof where such room shall be used for the consumption of alcoholic liquor by persons under the age of 21 years. (Ord. 0-89-54, 10-2-1989; amd. Ord. O-23-09, 3-20-2023, eff. 1-1-2024)
