3-9-4: LICENSE FEES:
   A.   Payment Required; Refund: Each application for a license shall be accompanied by a receipt from the city for payment in full of the required fee for the license. All fees shall be paid into the general fund of the municipality. Upon rejection of any applications for a license, the city may refund the license fee paid, minus the amount of costs necessary for application, investigation and review, including, but not limited to, costs relating to administration, planning, legal, inspection and police investigation.
   B.   Term; Proration: All licenses shall expire on December 31 of each calendar year. Each license shall be issued for a period of one year, except that if a portion of the license year has elapsed when the application is made, a license may be issued for the remainder of the year, any unexpired fraction of a month shall be counted as one month.
   C.   Annual Fee: The annual fee for an adult use-principal license shall be as set forth in section 3-9-12 of this chapter.
   D.   Criteria For Refund: No part of the fee paid by any licensee shall be refunded except in the following instances upon application to the city manager within thirty (30) days from the happening of any of the following events. There shall be refunded a pro rata portion of the fee for the unexpired period of the license, computed on a monthly basis, when operation of the licensed business ceases not less than one month before expiration of the license because of:
      1.   Destruction or damage of the licensed premises by fire or other catastrophe;
      2.   The licensee's disabling illness;
      3.   The licensee's death. (Ord. 227, 5-6-1997)
