§27-1702.   Permitted Use In Neighborhood Commercial Zoning District.
   Short-term rentals shall be permitted within the Neighborhood Commercial District, subject to all applicable requirements of Chapter 27 and performance standards, by right in accordance with the following:
      A.   Short-term rentals shall only be permitted in an existing building where the existing or prior approved use included a habitable dwelling unit. Addition of dwelling units is prohibited.
      B.   Short-term rentals shall only be permitted in a structure originally built as a single-family detached dwelling, single-family semi-detached dwelling, or two-family detached dwelling where all units are on the same lot or where each unit is under the same ownership.
      C.   Only 1 rental agreement shall be permitted per dwelling unit.
      D.   Parking shall be provided in accordance with Chapter 27. Additionally, parking surfaces must be constructed of asphalt, concrete, brick, paver blocks, or cobblestone on a 6-inch stone base. Outdoor parking spaces shall be delineated by painted lines having a minimum width of 4 inches. The use of mechanical parking lifts is prohibited.
      E.   The exterior of each short-term rental must maintain an orderly residential appearance.
      F.   Noise may not exceed comparable residential uses. When adjacent to a residential use, all rental contracts shall notify guests that outdoor activities are not permitted between the hours of 10:00 PM and 8:00 AM E.S.T. and must comply with the Borough of Dauphin Noise Ordinance.
      G.   Special events and public functions such as concerts, conferences, or weddings are prohibited on the lot of a short-term rental.
      H.   Access to the property and short-term rental unit must be maintained and remain clear of obstructions to accommodate emergency vehicles.
      I.   Signage is limited to a 1 square foot nameplate, excluding any signage identifying the street address of the property.
      J.   The owner or operator of the short-term rental must pay all state, county, and local taxes that are applicable to the temporary lodging.
      K.   The owner or operator of the short-term rental must provide the name and 24-hour contact phone number of the person responsible for the security and maintenance of the property to the Borough in writing before each occupancy of a unit. The contact phone number must also be posted in a visible but discreet location on the property.
      L.   The owner or operator of the short-term rental must register the unit(s) and pay the fee(s) for any rental inspection program operated by the Borough.
      M.   A zoning permit must be issued prior to the first contract for the short-term rental of any unit.
