1076.03 USE OF BASEBALL FIELDS.
   (a)   Only Village residents, Cuyahoga Heights School teams, Village baseball programs, Village company teams, and any other authorized baseball team with the Mayor’s approval shall be permitted to use the baseball fields. The Cuyahoga Heights Village Baseball program and the Cuyahoga Heights Schools have priority for use of the baseball fields.
   (b)   Use of the baseball fields at Bacci Park will be by permit only, obtainable through the Village Hall, with rules set forth by the Mayor's office. However, Village residents may use the fields for themselves or their children, until such time as a permit holder appears with a valid permit to use the baseball fields.
   (c)   A Village resident may obtain a permit for a team practice on a baseball field if the resident is a player on a team not affiliated with the Village. The resident must be participating in and be present at the practice.
   (d)   Company teams for companies located in the Village of Cuyahoga Heights may obtain a permit to practice on the fields.
   (e)   A permit for a baseball field may also reserve the use of the adjacent baseball pavilion at Bacci Park, if available, subject to the regulations set forth in Section 1076.06.
   (f)   Use of the baseball fields will require a twenty-five dollar ($25.00) deposit, which may be waived for the Cuyahoga Heights Village baseball program and the Cuyahoga Heights Schools. Permits shall be issued on a first come basis. However, no more than two permits shall not be issued to any applicant without separate approval of the Mayor to ensure fair opportunity for use of the baseball fields by other eligible permit seekers.
   (g)   The permit holder must be at the fields with the permit during use and must present the permit to the Police Department and other Village officials or representatives upon request.
