(a) Whoever violates Section 814.03 is guilty of a misdemeanor of the third degree for a first offense and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both. For each subsequent offense, such person is guilty of a misdemeanor of the second degree and shall be fined not more than seven hundred fifty dollars ($750.00) or imprisoned not more than ninety days, or both.

(b) Whoever activates a false alarm otherwise than by inadvertence, negligence or an unintentional act shall be guilty of a violation of Section 648.08 of the General Offenses Code and shall be subject to the penalty provided therein.
