311.04 OPERATION OF VEHICLES IN DOWNTOWN PEDESTRIAN AREAS.
   (a)   Unless a permit is issued by the Director of Community Development, no person shall operate a motor vehicle, motorized bicycle, bicycle, skateboard or scooter upon any pedestrian area within the area bounded on the south by Broad Boulevard, the east by the Cuyahoga River, the north by Oakwood Drive and the west by Second Street.
   (b)   This prohibition shall not apply to motorized wheelchairs or scooters used by the disabled, emergency vehicles, public safety vehicles or vehicles owned by the City.

   (c)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
