907.02 PERMIT REQUIRED.
   (a)   No person shall, by hand or machine, excavate a trench without first obtaining an Excavation Site Safety Permit from the Building Department. The provisions of this paragraph do not apply to a trench where:
      (1)   The trench is less than five feet in depth, and examination of the ground by a competent person provides no indication of potential cave-in, or
      (2)   No person enters the trench.
   (b)   No person shall excavate a trench without first displaying in a location facing and visible from a public street the permit required herein.
   (c)   The application form for obtaining an Excavation Site Safety Permit shall be established by the Building Department. An Excavation Site Permit shall expire 60 days after its issuance.
   (d)   Prior to excavating a trench, the person so excavating shall notify the Building Department of the date and time said excavation shall take place.
   (e)   The federal regulations of the Occupational Safety and Health Administration pertaining to the excavation of a trench are hereby adopted by the City and made applicable to the excavation of any trench by any person, including trenches excavated on private property by property owners.
   (f)   No person shall excavate or enter a trench without observing all federal, state, and local laws and regulations regarding the excavation and entering of a trench.
