1361.01 FOUNDATIONS, FLOORS, WALLS, CEILINGS, ROOFS, WINDOWS, DOORS AND PREMISES.
Every foundation, wall, roof, window, door and basement hatchway shall be reasonably weathertight, watertight and rodentproof, shall be capable of affording privacy, and shall be kept in sound condition and good repair in an approved manner. Floors, interior walls and ceilings shall be sound and kept in good repair. Garages and accessory buildings shall be maintained in a sound condition and good repair in an approved manner.
Exterior surfaces, including accessory buildings, shall be so maintained in good repair so as to provide a sufficient covering and protection of the structural surface underneath against its deterioration.
All exterior surfaces, other than decay resistant woods, brick, block or stone shall be protected from the elements and decay by paint or other protective covering or treatment. Toxic paint and materials shall not be used where readily available to children.
Without limiting the generality of this section, a protective surface of a building shall be deemed out of repair if:
(a) More than twenty-five percent (25%) of the area of any plane or wall on which the protective surface is paint is blistered, cracked, flaked, scaled or chalked away;
(b) More than twenty-five percent (25%) of the pointing of any brick, block or stone wall is loose or has fallen out.
Any abnormal surface drainage or roof drainage which creates a structural or health hazard to the owners or occupants of adjacent premises by reason of discharges into or onto any adjacent buildings or premises, shall be abated by the owners of the improperly drained areas. Every premises shall be free from hazards and conditions which might create a nuisance.
