1333.02 SWIMMING POOL FENCES.

   The owner, tenant or person having control of property within the City whereon a swimming pool or wading pool is located, shall construct or cause to be constructed an approved type fence of a minimum height of four feet around the perimeter of such pool or around the perimeter of the lot whereon the pool is located or in the areaway between the lot boundaries and the pool, but in no event in front of the setback line. Such fence shall be equipped with self-locking gates. The plans for the fence and/or gates described herein shall be approved by the Department of Building and Zoning Inspection before installation and shall be inspected by such Department upon the completion thereof. The Department of Building and Zoning Inspection is granted all authority under this section incidental to that department under the Building Code and Zoning Code of these Codified Ordinances. No swimming pool or wading pool shall be located in front of the building setback line. No variance shall be granted from the provisions of this section except by the Board of Zoning Appeals.
