1310.99 PENALTY.

   (a)    Violation of the provisions of this chapter or failure to comply with any of its requirements shall constitute a second degree misdemeanor. Whoever violates this chapter or fails to comply with any of its requirements, including violations of conditions of and safeguards established in connection with conditions, shall be fined or imprisoned as provided by the laws of the City. Nothing herein shall be construed as making any action or inaction of the Flood Plain Administrator or other official in the performance of his duties a criminal act under this section.

   (b)   Each day such violation continues shall be considered a separate offense. Nothing herein contained shall prevent the City from taking such other lawful action as is necessary to prevent or remedy any violation. (Ord. 52-2009. Passed 6-8-09.)
