1301.05 NONCONFORMING BUILDINGS; CHANGE OF USE OR OCCUPANCY.
   (a)    No person shall maintain, occupy or use a building or structure that has been erected or altered in violation of any provision of the ordinance which was applicable and in effect at the time such building was erected or altered.

   (b)    Before the use or occupancy of any building or part thereof can be changed, such building shall be made to substantially conform to the requirements of the Building Code for new buildings. If a portion of a building is changed in occupancy or use and that portion is separated from the remainder of the building with the required vertical and horizontal fire divisions complying with the appropriate sections of the Ohio Basic Building Code and the CABO, then the construction involved in the changes shall be made to conform to the requirements for the new use and occupancy and the existing portion shall be made to comply with the exit requirements of this Building Code.

   (c)    A use or occupancy shall be deemed to be changed when changed from a class or subclass to another class or subclass as classified according to use or occupancy in this Building Code.
   (d)    The legal use or occupancy of any structure existing on December 29, 1955, or for which it had been heretofore approved, may be continued without change, except as may be specifically covered in this Building Code or as may be deemed necessary by the Building Official for the general safety and welfare of the occupants and the public.
