901.05 RESPONSIBILITY FOR EXCAVATIONS.
Any earth, pavement or other materials excavated shall be deposited in such manner as to guard against inconvenience to the public by obstructing streets or sidewalks, and no excavation in any street or sidewalk shall be left open or unguarded. Excavations shall be provided with signal lights during the night time. All such places where pavement or other material is removed shall be restored to their former condition as speedily as is practicable, and all ditches or holes which are dug in streets or sidewalks or other public places shall be backfilled and when filled, shall be puddled and tamped into place and the street returned to its natural surface.
The person who digs or causes to be dug any excavation as heretofore described in any public street or other public place shall be responsible for the replacement of such street or sidewalk in as good condition as it was prior to the excavation having been made, and the cost and expense of such improvement shall be borne by the person causing such pavement, sidewalk or other improvement to have been made. In default thereof, the City shall replace the pavement or sidewalk in as good condition as it was prior to the excavation having been made and deduct the cost thereof from the cash deposit or from the certified check which was deposited with the Department of Public Service at the time the permit was issued.
