770.28 ABANDONING WELLS.

   (a)   In the event that a well is abandoned, it shall be the duty of the owner or lessee to notify the Zoning Inspector and the City Engineer of such abandonment before the well has been abandoned and the equipment removed.

   (b)   A permit fee of one hundred dollars ($100.00) will be charged and an abandonment inspection account established to reimburse the Division of Engineering for the cost of inspection service.

   (c)   All permit holders shall be required to plug the well in compliance with all of the rules and regulations promulgated by any department or division of the State relative to pulling, plugging and abandoning oil and/or gas wells and in addition thereto shall meet all of the following conditions:

      (1)    The well shall be plugged in accordance with current City of Cuyahoga Falls Division of Engineering standards;

      (2)    All above-ground appurtenances shall be removed in accordance with current City of Cuyahoga Falls Division of Engineering standards;

      (3)    A magnetically sensitive monument or marker shall be installed in accordance with current City of Cuyahoga Falls Division of Engineering standards;

      (4)    The ground shall be returned to original grade and condition in accordance with current City of Cuyahoga Falls Division of Engineering standards.
