(A) Where a national categorical pretreatment standard for a particular industrial category is more stringent than the corresponding limit of this chapter, such categorical standard shall supersede the limit of this chapter for that industrial category and become a requirement under this chapter. The city shall notify affected users of applicable limits, monitoring, and reporting requirements.
(B) Compliance dates.
(1) Existing categorical users that are subject to revision of an applicable national categorical pretreatment standard shall achieve compliance on or before the final compliance date specified in the revised standard.
(2) Existing sources that become categorical subsequent to promulgation of an applicable national categorical pretreatment standard shall achieve compliance on or before the final compliance date specified in the promulgated standard.
(3) New sources that will be subject to a national categorical pretreatment standard shall achieve compliance upon commencement of discharge to the POTW.
(C) Baseline monitoring report.
(1) Submittal dates.
(a) Existing categorical users that are subject to revision of an applicable national categorical pretreatment standard shall, within 180 days following revision of the standard, submit a baseline monitoring report to the WWTP Superintendent for each process regulated by the categorical standard and containing the information specified in this division.
(b) Existing sources that become categorical subsequent to promulgation of an applicable national categorical pretreatment standard shall, within 90 days following promulgation of the standard, submit a baseline monitoring report to the WWTP Superintendent for each process regulated by the categorical standard and containing the information specified in this division.
(c) New sources that will be subject to a national categorical pretreatment standard shall, at least 90 days prior to commencement of discharge to the POTW, submit a baseline monitoring report to the WWTP Superintendent for each process regulated by the categorical standard and containing the information specified in this division. Such new sources may provide an estimate of the flow, estimates of the quality and quantity of pollutants to be discharged to the POTW, and the anticipated pretreatment methods to be used to comply with the categorical standard.
(2) Submittal requirements. Baseline monitoring reports shall include the following at a minimum:
(a) Identifying information including name and address of the facility, and name of the owner or operator;
(b) A list of any environmental control permits for the facility;
(c) A brief description of the nature, average rate of production, and SIC classifications of operations at the facility, including a schematic process diagram that indicates points of discharge to the POTW from the regulated processes;
(d) Information on measured average daily and maximum daily flows to the POTW from regulated process streams, and other streams where necessary for the city to apply the combined wastestream formula of 40 CFR Part 403.6(e);
(e) All pretreatment standards and requirements applicable to regulated processes or to the discharge to the POTW;
(f) Results of sampling for the regulated pollutants in discharge from regulated processes and discharge to the POTW. Samples shall be representative of daily operations, and shall be collected and analyzed in accordance with procedures of this chapter and 40 CFR Part 403.12(b)(5)(iii) and (iv);
(g) A statement clearly indicating whether applicable pretreatment standards and requirements are being met on a consistent basis and, if not, what additional pretreatment or operation and maintenance (O&M) modifications will be implemented to enable compliance to be achieved;
(h) If additional pretreatment or other O&M modifications will be implemented, a schedule in accordance with 40 CFR Part 403.12(c) by which the user will complete such actions in the shortest time possible and no later than the final compliance date specified in the applicable categorical standard; and
(i) Certification and signature in accordance with § 51.054(F) of this chapter.
(3) Any changes to information submitted in a baseline monitoring report shall be reported to the WWTP Superintendent within 60 days of becoming aware of the change.
(D) Compliance status report.
(1) Submittal dates.
(a) Existing categorical users that are subject to revision of an applicable national categorical pretreatment standard shall, within 90 days following the final compliance date specified in the revised standard, submit a compliance status report to the WWTP Superintendent for each process regulated by the categorical standard and containing the information specified in this division (D).
(b) Existing sources that become categorical subsequent to promulgation of an applicable national categorical pretreatment standard shall, within 90 days following the final compliance date specified in the promulgated standard, submit a compliance status report to the WWTP Superintendent for each process regulated by the categorical standard and containing the information specified in this division (D).
(c) New sources that will be subject to a national categorical pretreatment standard shall, within 90 days following commencement of discharge to the POTW, submit a compliance status report to the WWTP Superintendent for each process regulated by the categorical standard and containing the information specified in this division (D).
(2) Submittal requirements. Compliance status reports shall include the following at a minimum:
(a) Average and maximum daily flow;
(b) Corresponding concentrations or values of all pollutants which are limited by the applicable national categorical pretreatment standards;
(c) Statement clearly indicating whether all applicable pretreatment standards and requirements are being met on a consistent basis; and
(d) Certification and signature in accordance with § 51.054(F) of this chapter.
(3) For users subject to national categorical pretreatment standards expressed in units per rate of production, the compliance status report shall include the actual production rate of the regulated process during the sampling period and a reasonable estimate of the expected long-term average production rate.
(E) Specific provisions applicable to categorical users.
(1) National categorical pretreatment standards shall apply at the point of discharge from the user’s categorical process, unless alternative limits are imposed pursuant to division (E)(3).
(2) All measurements, tests, and analyses of pollutant characteristics performed by a categorical user on discharges from a regulated process shall be in accordance with analytical procedures approved by EPA and listed in 40 CFR Part 136. Monitoring shall be carried out by composite sample or grab sample techniques pursuant to § 51.048(D) and (E) of this chapter, and shall ensure samples are representative of conditions during discharge to the POTW. Where historical sampling data do not exist, a minimum of four grab samples shall be collected for pH, cyanide, total phenols, oil and grease, sulfide and volatile organic compounds, as applicable. Where historical sampling data do exist, the WWTP Superintendent may establish an alternative minimum number of grab samples.
(3) When a user mixes wastewater subject to a national categorical pretreatment standard with wastewater not regulated by that standard, the city may impose alternative limits for that user using the combined wastestream formula of 40 CFR Part 403.6(e).
(4) When a user is subject to national categorical pretreatment standards expressed in terms of units per rate of production, the city may impose equivalent concentration limits or mass limits for that user in accordance with 40 CFR Part 403.6(c).
(5) When requested by a categorical user, the city may apply net/gross adjustments to an applicable national categorical pretreatment standard in accordance with 40 CFR Part 403.15.
(6) A categorical user may obtain a variance from an applicable national categorical pretreatment standard upon demonstration that factors relating to its discharge to the POTW are fundamentally different from the factors considered by EPA when developing that standard. This demonstration shall be in accordance with procedural and substantive provisions of 40 CFR Part 403.13.
