(A) Periodic compliance report.
(1) Significant industrial users, and other users where required by the city, shall submit to the city a report indicating the nature and concentration of pollutants in their discharge to the POTW in accordance with a wastewater contribution permit or order of the city.
(2) Reports shall be submitted to the WWTP Superintendent during the months of June and December, unless required more frequently by the city or a national categorical pretreatment standard. In consideration of such factors as local high or low rates, holidays, budget cycles and the like, the months during which compliance reports are to be submitted may be altered at the discretion of the city.
(4) In cases where the city has imposed mass limitations, the report shall indicate the mass of pollutants so regulated.
(5) In cases where the city has required certain actions associated with a BMP, the report shall include sufficient documentation for the city to determine compliance.
(6) If a user monitors any pollutant more frequently than required by the city, using methods contained in 40 CFR Part 136 or alternate methods approved by the WWTP Superintendent, results of this additional monitoring shall be included the report.
(7) All wastewater sample results reported to the city must be representative of the non-domestic user’s discharge to the POTW. It shall be the users responsibility to properly operate and maintain all wastewater monitoring equipment at all times. Failure of a user to maintain its monitoring equipment shall not be acceptable grounds for a claim of nonrepresentative sample results.
(8) Each submittal of a periodic self-monitoring report shall include a signed certification statement in accordance with division (F) of this section.
(B) Limit exceedance notifications; repeat sampling report.
(1) All non-domestic users shall verbally report to the WWTP Superintendent within 24 hours of becoming aware of any discharges to the POTW, whether intentional or accidental, which are known or reasonably suspected to violate any of the following:
(b) Limits in a wastewater contribution permit;
(c) Applicable national categorical pretreatment standards;
(d) Limits in any special agreement with the city; or
(e) Any other applicable law or regulation. In such cases, repeat sampling shall be immediately performed in accordance with division (B)(3) of this section.
(2) After providing the verbal limit exceedance notification, the user shall provide a written follow-up report to the WWTP Superintendent within five days of initially becoming aware of the exceedance. This report shall repeat the information required in divisions (B)(1)(a) through (e) of this division and provide all additional known details regarding the discharge to the POTW including but not limited to volume, duration, pollutant constituents, concentrations, loadings, cause, actions taken or to be taken to prevent future exceedances, and other relevant information.
(3) If the sampling was performed by the user, repeat sampling shall be immediately performed and results submitted to the WWTP Superintendent within 30 days of becoming aware of the exceedance. If the sampling was performed by the city, the WWTP Superintendent will notify the user of said exceedance. The user shall immediately perform a repeat of the sampling and submit results to the WWTP Superintendent within 30 days of this notification, except as follows:
(a) The city samples the user’s discharge to the POTW at a frequency of at least once per month; or
(b) The city will sample the user’s discharge to the POTW between the time of the user's sampling that indicated an exceedance and the time when the user would perform the repeat sampling.
(4) Significant industrial users, and other user where required, shall post a clearly legible set of instructions in the area where wastewater is managed to ensure that these notice and reporting requirements are known by the user’s employees. Any user with a wastewater contribution permit shall post a copy of the current permit with these instructions. All employees who have responsibilities relating to the user’s wastewater shall be provided with initial training, and at least annual refresher training, on these notice and reporting requirements.
(5) Whenever possible, advanced written notification shall be provided to the WWTP Superintendent of any discharge to the POTW that may violate conditions of (B)(1)(a) to (e) of this section. This notification shall provide all known details regarding this discharge including but not limited to volume, duration, pollutant constituents, concentrations, loadings, cause, actions taken or to be taken to prevent future exceedances, and other relevant information necessary for the WWTP Superintendent to determine what impact the discharge may have on the POTW.
(6) Each written submittal of a limit exceedance notification shall include a signed certification statement in accordance with division (F) of this section.
(C) Notification of changed discharge.
(1) All nondomestic users shall provide written notification to the WWTP Superintendent in advance of any substantial change in the nature, quality, or volume of its discharge to the POTW, including any changes to their operations that may affect the potential for a slug discharge.
(2) For purposes of this division, a substantial change includes but is not limited to flow increases of 10% or greater than previously reported pursuant to § 51.020, pollutant concentration increases of 10% or greater than previously reported pursuant to § 51.020, and discharge to the POTW of any pollutants not previously reported pursuant to § 51.020. Also included are any hazardous waste discharges to the POTW for which the user is required to submit a notification under division (E) of this section.
(3) The notification shall be made at least 90 days before a planned change, if possible. If not possible, the notification shall be made as soon as the planned change becomes known.
(4) The WWTP Superintendent may require the user to submit additional information as may be deemed necessary to evaluate the changed conditions, including submission of a new industrial waste questionnaire pursuant to § 51.020.
(5) The WWTP superintendent may revise and reissue an existing wastewater contribution permit, or issue a new wastewater contribution permit, in response to the changed conditions.
(6) Each written submittal of a notification of changed discharge shall include a signed certification statement in accordance with division (F) of this section.
(D) Notification of potential problems, including slug loads.
(1) In the case of any non-routine discharge to the POTW that violates any prohibition under § 51.040 or § 51.041 of this chapter or any applicable national categorical pretreatment standard including but not limited to slug loadings, accidental discharges, discharges resulting from upsets or unanticipated bypasses, discharges of a episodic nature, and non-customary batch discharges, all nondomestic users shall verbally notify the WWTP Superintendent within 24 hours of becoming aware of an upset or unintentional bypass and provide the following information:
(a) A description of the non-routine discharge to the POTW including all known information on location, type of waste, concentration, and volume;
(b) Period of the non-routine discharge to the POTW including exact dates and times or, if not corrected, the anticipated time the discharge is expected to continue; and
(c) Corrective action being taken reduce, eliminate, and prevent recurrence of non-routine discharges to the POTW.
(2) Within five days of this verbal notification, the user shall provide to the WWTP Superintendent a written submission containing the information contained in divisions (D)(1)(a), (b), and (c) of this section. The WWTP Superintendent may waive the written report on a case-by-case basis if the verbal report has been received within the required time period.
(3) Each written submittal of a notification of potential problems shall include a signed certification statement in accordance with division (F) of this section.
(E) Notification of hazardous waste discharge. All users shall notify the WWTP Superintendent, the State Hazardous Waste Director, and the EPA Regional Waste Management Division Director in writing of any discharge to the POTW of a substance which would be classified as a hazardous waste if disposed via other means. Reporting requirements shall be in accordance with 40 CFR 403.12(p).
(F) Signature and certification. All written reports submitted pursuant to this section shall be signed by an authorized representative of industrial user, and certified using the following statement:
"I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations."
