§ 94.085 SHORT TERM RENTALS.
   (A)   Purpose. The purpose of this § 94.085 is to protect and preserve the quiet enjoyment of residential properties and neighborhoods within the village and to mitigate and/or eliminate adverse secondary effects the village and its residents are likely to experience by reason of short term rental(s) of certain residential structure(s) in the village, including, but not limited to, gatherings by attendees who have little connection to or consideration for the neighborhoods or neighbors, which gatherings are likely to be characterized by excessive noise, overcrowded parking and criminal activity.
   (B)   Definitions. For the purposes of Chapter 94 of the Code of Crestwood, the following phrases shall have the definitions as set forth below:
      (1)   Rental premises. All or part of a principal structure or accessory structure in a residentially zoned district being rented or otherwise let to person(s) other than the owner of the subject property.
      (2)   Short term rental. The accessory use and/or occupancy for a period of less than three consecutive months of a principal structure or accessory structure pursuant to a written or oral agreement which permits and/or provides for occupancy of all or part of such structure by any person other than the owner thereof, or an immediate family member of the owner thereof, and whether or not the permission of such occupancy is in exchange for consideration therefore.
   (C)   Registration required; Applicable Code. The provisions of the preceding section of the code as set forth in § 94.084 shall be applicable to short term rentals.
   (D)   Penalty. Notwithstanding anything otherwise provided in the Code of Crestwood, any person who violates any provision of this § 94.085, upon conviction thereof, shall be fined not less than $250 and a separate offense shall be deemed committed each day a violation occurs or continues.
