§ 74.11 SIZE AND WEIGHT REGULATIONS.
   (A)   Definitions. For the purposes of this section, the following definitions apply.
      ANNUAL TRIPS. Those trips that are known to be continuous in nature. Annual-trip permits are valid for a period not to exceed 365 days from the date of issuance.
      CHIEF OF POLICE. The Chief of Police for the Village of Crestwood Police Department.
      NON-DIVISIBLE. A load or vehicle that, when separated into smaller loads or vehicles, further dismantling would:
         (a)   Compromise the intended use of the load or vehicle, or make it unable to perform the function for which it was intended;
         (b)   Destroy the value of the load or vehicle or make it unusable for its intended purpose;
         (c)   Require more than eight work hours to dismantle using appropriate equipment. The applicant for a non-divisible load has the burden of proof as to the number of work hours required to dismantle the load.
      POLICE DEPARTMENT. The Village of Crestwood Police Department.
      QUARTERLY TRIPS. Those trips that are known to be continuous in nature. Quarterly-trip permits shall be for a period not to exceed 90 calendar days from the date of issuance, unless otherwise directed by the Police Department.
      ROUND TRIP. Two trips over the same route in opposite directions. Round-trip permits are effective for ten consecutive calendar days from the date of issuance, unless otherwise directed by the Police Department. Any additional stops between the points of origin and the point of destination are expressly prohibited.
      SINGLE TRIP. One trip from the point of origin to the point of destination. Any additional stops between the point of origin and the point of destination are expressly prohibited. Single-trip permits are effective for five consecutive calendar days from the date of issuance, unless otherwise directed by the Police Department.
      VILLAGE. The Village of Crestwood, Cook County, Illinois.
   (B)   Restrictions on weight and size enforced.
      (1)   A permit shall be required for the movement of any vehicle or combination of vehicles, which is non-divisible or is carrying a load which is non-divisible, while operating on the highways owned and maintained by the village, that exceeds the maximum size and weight limits described in ILCS Ch. 625, Act 5, §§ 15-102 (width), 15-103 (height), 15-107 (length), and 15-111 (weight), as amended.
      (2)   All single-trip, round-trip, quarterly-trip and annual-trip permits are limited to movements on assigned routes only and cannot be used to avoid using a state, county or township road or highway.
      (3)   Maximum limitations.
         (a)   All quarterly-trip and annual-trip permits are restricted to the following maximum limitations:
            1.   Twelve feet, zero inches in width;
            2.   Thirteen feet, six inches in height;
            3.   One hundred fifteen feet, zero inches in length.
         (b)   The maximum dimensions for single-trip- and round-trip-permit requests shall be approved on a case-by-case basis.
   (C)   Exempt vehicles. The following vehicles shall be exempt from the permit requirements set forth in this section:
      (1)   Fire Department vehicles;
      (2)   Those vehicles operating under an emergency declaration;
      (3)   Those vehicles and any equipment used for snow or ice removal and owned or operated by or for any governmental body;
      (4)   Implements of husbandry;
      (5)   Public utility vehicles owned or operated by the village, other public bodies, public utility companies, or any contractor or material man thereof, while engaged in the repair, maintenance or construction of streets or utility facilities within the village, or while traveling to or from such street repairs or public utility facilities, where the only access to such repairs or utility facilities is over streets within the village that have not been designated truck routes;
      (6)   Vehicles engaged in the collection and removal of garbage or refuse.
   (D)   Issuance of permits.
      (1)   The Chief of Police, or his/her designee, may issue a special permit authorizing the owner, operator or lessee of an oversize or overweight vehicle, or combination of vehicles, to operate on any highway owned and maintained by the village. Permits shall be issued only in the name of the person, firm, business or corporation that owns and operates the transporting vehicle or operates the vehicle under a bona fide lease agreement.
      (2)   The permit, when issued, constitutes an agreement between the permittee and the village that the move described in the application will take place only as described.
      (3)   Permits are to be issued for good cause to insure movements will not unduly damage village highways.
      (4)   Permits are only valid for the dates and times specified, and the Chief of Police, or his/her designee, is authorized to create and amend reasonable provisions for permits. Permits for oversize vehicles are valid only a half hour before sunrise until a half hour after sunset, on any day that a permit issued by the Illinois Department of Transportation is valid.
      (5)   Permits are non-transferable to other vehicles and must be carried in the permitted vehicle, in either paper or electronic form, unless otherwise directed by the Police Department and presented upon demand to any police officer for inspection.
      (6)   No substitution of vehicle, load or routing is permitted without expressed, written permission by the Chief of Police or his/her designee.
      (7)   No permits shall be issued to an applicant who has outstanding fees or payments due to the village.
   (E)   Permit fees.
      (1)   Fee schedules.
         (a)   The fee schedule for overweight (including overdimension) vehicles shall be as follows:
            Single trip (5 days):      $50
            Round trip (10 days):      $80
            Quarterly (90 days):       $200
            Annual:         $800
         (b)   The fee schedule for oversize only (legal weight) vehicles shall be as follows:
            Single trip (5 days):      $25
            Round trip (10 days):      $40
            Quarterly (90 days):      $100
            Annual:         $400
      (2)   Revisions to permits. The Police Department, in its discretion, may issue revisions to permits for a fee of $20 (or 50% of the original permit fee if the original permit fee was $30 or less):
         (a)   To correct an error attributed to the Police Department (no revision fee);
         (b)   To correct an error attributed to the applicant, discovered before the move;
         (c)   To adjust weights, dimensions or routes as issued on the permit, before the move is made.
      (3)   Collection of fees. The village is responsible for the collection of permit fees and may make rules and regulations as to acceptable methods of payment and due dates. Any unpaid permit fees will be turned over to a collection agency under contract with the village.
   (F)   Applications for permit.
      (1)   The owner, operator or lessee shall apply for a permit, under this section in the method and form provided by the village, along with the applicable fee set forth in division (E).
      (2)   All applications for permits shall be given full consideration. Permits for proposed moves may be issued when:
         (a)   The highways owned and maintained by the village will not be unduly damaged; and
         (b)   The safety of the traveling public will be adequately protected.
      (3)   Applications for a permit to move an oversized and overweight vehicle and/or load must be made to the Police Department. In addition to any other information deemed necessary by the Police Department, the following information shall be included in the permit application:
         (a)   The name and address of the owner or lessee of the vehicle;
         (b)   The applicant’s name;
         (c)   The type of permit requested (e.g., annual, single-trip, quarterly, round-trip);
         (d)   The type of vehicle(s) and vehicle(s) make;
         (e)   The weight(s) and dimensions of the vehicle(s);
         (f)   Description of the load;
         (g)   The highways under the jurisdiction of the village to be traveled.
   (G)   Approval of permit application. The Chief of Police, or his/her designee, is authorized to approve the permit application. Upon approval, the Chief of Police shall issue a permit allowing travel of the oversized and/or overweight vehicle over streets and highways owned and maintained by the village. The permit, issued on forms provided by the village or using an electronic permit service, shall be specific and contain, at minimum:
      (1)   Permit number;
      (2)   The date the permit is valid and the date the permit expires;
      (3)   Whether the permit is single-trip, round-trip, quarterly or annual;
      (4)   The description of the object or vehicle to be moved;
      (5)   Authorized gross weight, individual axle weights, width, length and height; and
      (6)   The date and signature, written or electronic, of the Chief of Police or his/her designee.
   (H)   Duties of permittee.
      (1)   It is the duty of the permittee to read and understand the permit provisions upon receipt. The permittee has the responsibility to report to the village any inaccuracies or errors on the part of either the village or the permittee before starting any move.
      (2)   It is the duty of the applicant to verify the non-divisibility of the vehicle(s) and/or load(s) before making application for the permit. The permit application, itself, is prima facie evidence that the applicant confirmed the vehicle(s) and/or load(s) were non-divisible.
      (3)   Undertaking the move is prima facie evidence of the permittee’s acceptance of the permit as issued and its terms, and that:
         (a)   The permittee is in compliance with all operation requirements;
         (b)   No dimension and weight limitations specified in the permit will be exceeded;
         (c)   All operation, registration, and license requirements have been complied with;
         (d)   All financial responsibilities, obligations, and other legal requirements have been met; and
         (e)   The permittee assumes all responsibility for injury and damage to persons or to public or private property, including his or her own, or to the object being transported, caused directly or indirectly by the transportation or movement of vehicles and objects authorized under the permit. The permittee agrees to hold the village harmless from all suits, claims, damages, or proceedings of any kind, and to indemnify the village for any claim it may be required to pay arising from the movement.
      (4)   If required, arrangement shall be made by the permittee to have the proper utilities notified, property moved, bridge or highway analysis performed and completed in advance of any permit movement.
      (5)   All movements made by a permittee under a permit shall be made in accordance with all applicable federal, state and local laws, ordinances and rules and regulations.
   (I)   Denial, suspension and reinstatement.
      (1)   The Chief of Police, or his/her designee, shall administer and enforce this section, and shall have the authority to grant, deny, suspend or reinstate permits. Any applicant or permittee denied a permit or who has had a permit suspended, upon written request, shall be given a hearing before the Chief of Police, or his or her designee, first, then before the Village Services Director if the permittee is still unsatisfied.
      (2)   Permits are null and void if altered for the purpose of deception.
      (3)   The permits issued under this section constitute a grant of a privilege by the village, and may be denied or suspended for such reasons as the village may deem rationally related to its governmental interests including, but not limited to:
         (a)   A permittee fraudulently provides incorrect information in an application for a permit; or
         (b)   A permittee, its agents or employees operating on a permit that has been altered for the purposes of deception; or
         (c)   Non-compliance by permittee, its agents or employees with federal, state, or local ordinances pertaining to the transport of goods or operation of a vehicle engaged in the transport of goods; or
         (d)   Moving on village streets or highways without a valid permit as required under this section.
      (4)   A vehicle(s) and/or load found to be divisible will render the permit null and void.
      (5)   Suspension of a current permit issued under this section shall be for the time determined appropriate by the Police Department; however, reinstatement may be made upon conditions determined by the village and payment of all outstanding settlements or judgments.
   (J)   Police escorts. Civilian or police escorts shall be required at the discretion of the Police Department. The total number of police officers necessary to provide for a safe move shall be determined by the Police Department. Fees for police escorts shall be in addition to the permit fees set forth herein and included in the billing, invoicing and collection of permit fees. Police escort fees shall provide for a minimum of two hours of service, calculated by the most current overtime rate established by the Police Department.
