§ 151.99 PENALTY.
   (A)   Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
   (B)   Any person who shall violate any provision of §§ 151.01 through 151.07 shall, upon conviction thereof, be sentenced to pay a fine of not more than $600 plus costs and, in default of payment of said fine and costs to a term of imprisonment not to exceed 30 days. Each day that a violation of §§ 151.01 through 151.07 continues shall constitute a separate offense.

   (C)   Any person who shall violate any provision of §§ 151.20 through 151.23, shall upon conviction thereof, be sentenced to pay a fine of not more than $600 plus reasonable attorney fees and court costs and, in default of payment of said fine and costs to a term of imprisonment not to exceed 30 days. Each day that a violation of §§ 151.20 through 151.23 continues shall constitute a separate offense.
   (D)   Any individual who violates §§ 151.35 through 151.46 shall pay a fine as set forth herein for each offense plus all direct and indirect costs incurred by the borough for the enforcement, clean up and/or abatement of the violation:
      (1)   Violation ticket fines. For a first violation of §§ 151.35 through 151.46, the fine shall be in the amount of $25;
      (2)   Violation ticket penalties. If the person in receipt of a violation ticket does not pay the fine or request a hearing within 15 days, the person shall be subject to a $10 penalty for days 16 through 30;
      (3)   Hearing. A hearing shall be held by Borough Council at the conclusion of its regularly scheduled meeting;
      (4)   Failure to respond. If an individual fails to either make payment or request a hearing within 30 days of a violation ticket, said individual shall be subject to a citation for failure to pay;
      (5)   Repeated violations. Once four tickets have been issued for the same violation, a citation shall be issued by the public officer for the fifth and subsequent offenses;
      (6)   Continuous or egregious violations. If violations are continuous in nature or are egregious, a public officer has the right to issue a citation without first issuing a ticket provided notice has been given. Any previously issued violation tickets shall be considered notice given; and
      (7)   Citation fines. Any individual who shall fail, neglect or refuse to comply with any of the terms of §§ 151.35 through 151.46, or of any regulation or requirement pursuant thereto and authorized hereby shall, upon conviction, be ordered to pay a fine of not less than $300 nor more than $1,000 on each offense or imprisonment for no more than 90 days, or both.
