MAINTENANCE ALONG STREETS
§ 93.01 RESPONSIBILITY FOR TRIMMING.
   Every person or persons, partnership, firm or corporation owning any property upon which any tree may be growing shall be required to keep every such tree trimmed so that there shall be a clearance of at least eight feet between the lowest limb or portion thereof and the surface of the sidewalk below, and at least 14 feet between such lowest limb or portion thereof and the surface of the cartway of any street or public alley below, in order that no such tree shall interfere with or be an obstruction to pedestrian or vehicular traffic.

§ 93.02 CERTAIN TREES CONSTITUTE NUISANCE.
   Every tree now or hereafter growing upon or along any street, sidewalk or public alley in the borough, which shall have grown so large as to interfere with and obstruct the public use of any street, sidewalk or public alley in the borough, and every such tree that shall have become so old and decayed as to become dangerous to the traveling public is hereby declared to be a public nuisance and the same shall be removed by the owner or owners thereof, upon notice from the Borough Council.

§ 93.03 NOTICE TO TRIM OR REMOVE; AUTHORITY OF BOROUGH.
   (A)   The Borough Council is hereby authorized to notify the owner of any property upon which any tree shall be growing to trim such tree in accordance with the provisions of § 93.01, and upon failure of such owner to do so after ten days’ notice, the Council may cause the same to be done at the expense of such defaulting property owner and the cost of such trimming, with an additional amount of 10% thereof, shall, be collected from such property owner in the manner provided by law.
   (B)   The Borough Council is also hereby authorized to notify the owner of any property upon which any tree shall have become a public nuisance as provided in § 93.02, to remove such tree within five days notice thereof, and upon failure of such owner to do so, the Council may cause the same to be done at the expense of such defaulting property owner and the cost of such removal, with an additional amount of 10% thereof, shall be collected from such property owner in the manner provided by law.
