§ 150.01 ADOPTING INTERNATIONAL PROPERTY MAINTENANCE CODE AND KENTUCKY RESIDENTIAL CODE BYREFERENCE.
   (A)   International Property Maintenance Code.  
            (1)   Adoption by reference. Pursuant to the authority of KRS 83A.060(5), the 2021 International Property Maintenance Code, which was published in 2020 by the International Code Council, Inc., a copy of which is hereby made a part of the permanent records of the city; and the provisions thereof are hereby adopted by reference thereto, without setting them out in full, but with the revisions and amendments provided in division (A)(2).
      (2)   Revisions and amendments. The 2021 International Property Maintenance Code is hereby amended as follows:
         Section 101.1 on page 1 thereof is hereby amended as follows:
            101.1 Title. These regulations shall be known as the Property Maintenance Code of the City of Crescent Springs, hereinafter referred to as “this code.”
   (B)   Kentucky Residential Code.  
      (1)   Adoption by reference. Pursuant to the authority of KRS Ch. 198B, certain documents, copies of which are on file in the office of the City Clerk and the Planning Development Services of Kenton County, being marked and designated as the 2018 Kentucky Residential Code, are hereby adopted as the code of the city for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of one- and two-family dwellings and townhouses not more than three stories in height in the city, and providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, conditions and terms of such 2018 Kentucky Residential Code are hereby referred to, adopted, and made a part hereof as if fully set out in this section.
      (2)   Revisions and amendments. The 2018 Kentucky Residential Code is hereby amended as follows:

§ 150.02 RESERVED.
§ 150.03 SINGLE-FAMILY DWELLINGS.
   (A)    Pursuant to KRS 198B.010(4) this section authorizes the city to extend the application of the State Building Code to single-family dwellings.
   (B)    The application of the Kentucky Building Code is extended to all single-family dwellings in the city which are to be constructed or remodeled.

§ 150.04 FEES ADOPTED BY REFERENCE.
   (A)   Fees adopted by reference. The city hereby adopts by reference as if attached the Schedule of Fees dated July 2005 as attached to Ordinance 2005-17, passed 7-11-05, as recommended by the NKAPC for the processing and issuance of Zoning Permits, Building Permits, Electric Permits, Board of Adjustments hearing fees, and finds for violations of these life safety codes when a violation of them has been classified as a civil offense.
   (B)   Fees to be increased annually. In order for the schedule of fees, as adopted in division (A), to continue to reflect the increasing inflationary costs of administration of the above programs, said fees shall, on an annual basis, be adjusted by the NKAPC and reviewed by the City Treasure to reflect any increase that would be necessary with the conventional application of the Consumer Price Index as promulgated by the Kentucky Office for Local Government to these fees. Based upon this calculation said fees shall be increased annually and this schedule of fees shall be so amended by operation of this provision.

§ 150.05 ADOPTING FIRE PREVENTION CODE BY REFERENCE.
   The Kentucky Standards of Safety (Fire Prevention Code) as promulgated in 815 KAR 10:040 by the Commissioner of the Department of Housing, Buildings and Construction on the advice and recommendation of the State Fire Marshal, is hereby adopted by reference, as if fully set forth herein.

§ 150.06 DESIGNATED ENFORCEMENT OFFICER.
   The Chief of the Crescent-Villa Fire Authority or such other designee shall be designated as the local enforcement agent for said standards of safety.

§ 150.07 PRIMARY JURISDICTION OVER THE INSPECTION OF ALL PROPERTY.
   (A)   Pursuant to KRS 227.320, the city hereby adopts a fire inspection program in accordance with the standards of safety as promulgated by the Commissioner of the Kentucky Fire Commission and as set forth in 815 KAR 10:060 and as from time to time amended.
   (B)   Pursuant to 815 KAR 10:060, the Chief of the Crescent-Villa Fire Department has primary jurisdiction to inspect property within the city, except for those structures over which the state Fire Marshal has exclusive jurisdiction, being state-owned property and jurisdiction for code compliance for health care facilities and other facilities licensed by the Kentucky Cabinet for Health and Family Services as provided in 815 KAR 10:060.

§ 150.99 PENALTY.
   (A)   Any person who shall violate a provision of the national or state codes adopted by reference in § 150.01 or any other provision of this chapter shall, upon conviction thereof, be subject to a civil offense fine of not less than $100 for the first offense, $200 for the second offense and $400 for a third or any subsequent offenses. These fines may be collected by any Code Enforcement Board of the city or any unified Code Enforcement Board of which the city is a member.
   (B)   For any violation and fine appealed from the Code Enforcement Board to the Kenton District Court, the fines shall be $200 for a first offense, $400 for a second offense, and $800 for a third and subsequent offenses.
