§ 10.99 GENERAL PENALTY.
   (A)   Any person, firm, or corporation who violates any provision of this code for which another penalty is not specifically provided shall, upon conviction, be subject to a fine not exceeding $2,500. A separate offense shall be deemed committed upon each day during which a violation occurs or continues.
      (1)   Any person adjudged guilty of violating any provision of this code of ordinances may also be adjudged to pay the costs of prosecution.
      (2)   Any person adjudged guilty of violating this code, who fails to pay the fine and costs, shall be subject to further penalties as provided by this code and by the laws of the State of Indiana. If applicable laws of the state and ordinances of the city permit, such person adjudged guilty of violating this code who has failed to pay fines and costs, if physically able, shall
perform manual labor for the city, and a reasonable amount shall be allowed for such labor until such fines and costs are paid and the defendant released, or until his term has expired under such penalty provisions.
      (3)   Failure of a city officer to perform a duty prescribed by this code shall not subject such officer to any penalty under this code, unless a penalty is specifically provided.
      (4)   Each penalty clause or provision of the code shall include all of the provisions of this section, by reference hereto, which shall be included in each penalty section of the code.

   (B)   Notwithstanding the provisions of any section of this code setting forth a penalty, the maximum penalty which may be imposed for any violation shall not be less than the penalty prescribed by statutes for the same offense. ('85 Code, § 1.07)
   (C)   Reference to any section of this code includes the penalty section relating thereto, unless otherwise expressly provided. In case of the amendment of this code, any penalty provided in this code shall be held to relate to the amendment whether reenacted in the amendatory ordinance or not, unless such penalty is specifically repealed or amended therein.
