4-1-20: PENALTIES AND DISCIPLINARY MEASURES:
   A.   Penalties: Penalties may consist of the following:
      1.   Reprimand by the Chief of Police and Board of Fire and Police Commissioners.
      2.   Temporary suspension during the pendency of charges by the Board of Fire and Police Commissioners for a period not to exceed thirty (30) days.
      3.   Suspension for not more than thirty (30) days after hearing duly required by law.
      4.   Discharge from the Police Department and service of the City, after hearing duly held as required by law. (Whenever disciplinary action is taken against a member of the Department, such action will be posted on the personal record).
      5.   The Chief of Police shall have the right to suspend a subordinate officer for a period not to exceed five (5) days and shall file a copy of said order of suspension with the Board of Fire and Police Commissioners the day said suspension is made, and the police officer so suspended shall have twenty four (24) hours within which to appeal said suspension in writing from the time of receipt of notice of said suspension by the Chief. The Board shall conduct a hearing on said suspension as in the case of charges having been filed against said officer. (1970 Code §3-1-17.1)
   B.   Discipline: A commanding officer is required to report any violation to his immediate superior of the Rules and Regulations by a member of his command. Civility, sobriety, neatness, punctuality, prompt obedience to the orders and compliance with the Rules and Regulations is demanded of each member of the Department whether on or off duty. A superior officer is responsible for bad conditions in his command. (1970 Code §3-1-17.2)
   C.   Complaints by Subordinates: A subordinate having a complaint against another member of the Department for a violation of a rule, or deeming himself aggrieved, shall make a statement thereof under oath, attaching names of witnesses, and transmit same directly to the Chief of Police who shall take appropriate action. (1970 Code §3-1-17.3)
   D.   Preferring and Contents of Charges: Any superior officer may prefer charges against a subordinate for any one or more of the following offenses:
      1.   Any violation of these Rules and Regulations.
      2.   Any order of the Chief of Police or direct order of a superior officer, whether oral or written.
      3.   Any violation of law including a violation of an ordinance of the City, State statute or Federal statute.
Charges shall specify the rule violated, the general nature of such violation, and the names and addresses of witnesses. The defendant shall be notified of the contents of charges and shall be requested to submit a written statement in answer thereto. Charges, together with respondent's statement, if any, shall be forwarded through official channels of the Board of Fire and Police Commissioners. (1970 Code §3-1-17.4)
   E.   Proceedings Before The Fire And Police Commission: Proceedings before the fire and police commission shall be in accordance with the Illinois municipal code 1 and in accordance with the rules and regulations of the board of fire and police commissioners. (1970 Code §3-1-17.5)
   F.   Return Of Property: Upon suspension of a member of the department, he shall promptly surrender such department property in his possession as directed by the chief of police. Said property shall be retained by the chief of police, and returned to the officer when relieved from suspension or restored to duty. (1970 Code §3-1-17.6)
